On motion of Councilm-- Hubbard, seconded by Councilman Harvey and carried, Council denied the reclassification but instructed the Planning Department to accept an application for a variance for the same usage without an additional fee. Planning C.~m~ission Resolution 5676 recc~maended approval of w~ibit AA 488 A o The Clerk reported that evidence of giving notice of the hearing was on file in the Clerk's office and that no written cvmm~uications had been received. There being no response to the call for testimony, the hearing was closed. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, Council approved the reclassification and instructed the City Attorney to prepare an ame~af~ ordiuance according to Exhibit AA 488 A. The City Attorney notified Council the Court had set a hearin~ On the matter and rec~nded action be postponed until after a Court determination had ~een made. Stanley C. Goml~, 900 N. ~r~adway, attorney representing Acker Ambulance Service amd M~rgan Amb,,1-~ce Service~ suggested that a study be made of the ordinances reg-lating ambulances by a Council c~=m~ttee and that Council make a determimation prior to the Ccm~t hearing on May 14th. Mayor Hall noted that the City Attorney had been instructed to review the ordinamces and to clarify certain sections before that time. ~n Rryamt, 900 No Broadway, attorney for Windh Ambulance, concurred with waiting for the City Attorney's ruling. On motion of Couucilm-~ Hubbard, seconded by Councilman Schlueter and carried, Council continued the hearing to May 4, 1964, 7:BO porn., in the Council Chamber, 217 North Main Street. APPEAL 123 Mayor Hall opened the hearing on Appeal E & R DEVELOPMENT 12~ filed by E & R Development Co., Imco, COo from the Zoning Administrator's denial of Variance Application 1910 to construct six, single-famfly residential u~its on an R 1 lot at 5105 W. 7th Street. The Clerk reported that evidence of givtnE notice of the hearing was on file in the Clerk's office end that no written communications had been received. Phillip Schindler, Union Bank B~ilding, Orange, representing E & R Development Co., submitted a revised plot plan, and spoke in support of the appeal noting that adjacent property is R 2. There being no further testimony, the hearing was closed. On motion of Councl~m-n Harvey, seconded by Coumcilman Hubbard and carried, Council upheld the action of the Zcming Administrator and instructed the City Attorney to prepare a resolution denying Variance 1910.
