On motion of Councilm-- Hubbard, seconded by Councilman Harvey and carried, <br />Council denied the reclassification but instructed the Planning Department <br />to accept an application for a variance for the same usage without an <br />additional fee. <br /> <br />A~mMD. The City Attorney notified Council the Court had set a hearin~ <br />On the matter and rec~nded action be postponed until after a Court <br />determination had ~een made. <br /> <br />Stanley C. Goml~, 900 N. ~r~adway, attorney representing Acker Ambulance <br />Service amd M~rgan Amb,,1-~ce Service~ suggested that a study be made of the <br />ordinances reg-lating ambulances by a Council c~=m~ttee and that Council <br />make a determimation prior to the Ccm~t hearing on May 14th. <br /> <br />Mayor Hall noted that the City Attorney had been instructed to review the <br />ordinamces and to clarify certain sections before that time. <br /> <br />~n Rryamt, 900 No Broadway, attorney for Windh Ambulance, concurred with <br />waiting for the City Attorney's ruling. <br /> <br />On motion of Couucilm-~ Hubbard, seconded by Councilman Schlueter and carried, <br />Council continued the hearing to May 4, 1964, 7:BO porn., in the Council <br />Chamber, 217 North Main Street. <br /> <br />APPEAL 123 Mayor Hall opened the hearing on Appeal <br />E & R DEVELOPMENT 12~ filed by E & R Development Co., Imco, <br />COo from the Zoning Administrator's denial <br /> of Variance Application 1910 to construct <br />six, single-famfly residential u~its on an R 1 lot at 5105 W. 7th Street. <br /> <br />The Clerk reported that evidence of givtnE notice of the hearing was on file <br />in the Clerk's office end that no written communications had been received. <br /> <br />Phillip Schindler, Union Bank B~ilding, Orange, representing E & R Development <br />Co., submitted a revised plot plan, and spoke in support of the appeal noting <br />that adjacent property is R 2.
