Richard Ritual, attorney for the applicant, reviewed the facts and stated that the land uses on Grand are consistent with C 5. There being no further testimony, the hearing ~as closed. It was moved by Councilman Burk, seconded by Councilman ~larkel and carried, that Council approve the prezonimg amd instruct the City Attorney to prepare am amending ordinance according to E~hibit AA 556 B. HEARING - Hearing was opened om Amendment AA 558 - BAN~S Application 558 filed by Paul V. Banks proposing the amend- ment of Sectional District Map 13-5-10 by reclassifying from the R i to the R B district, property om the north side of West Cubbon between South B~istol and South Baker. Plaguing Commission Resolution 5749 reccm=~ended approval. Paul V. Banks, 1610 S. Flower, applicant, presented a petition with about 12 s~gmatures of residents with no objections to the reclassi- fication. Edward L. Elizalde, 1213 W. Cubbon, speaking em behalf of neighboring residents presented a petition stating their opposition because two-story apartments would damage the R 1 area; would eventually raise the taxes; a~d would create traffic hazards because of the ~arrow street amd increased usage. Ralph Drennam, 1918 Woodland Place, stated that his property would he difficult to rent if dominated by two-story apartments. There being no further testimony, the hearing was closed. The Plam~ing Director s,,-.,arized the attitude of the Planning C~w~esion on this area, stating there is everything frcm commercial to apartments, amd when they recommended approval of this application they set a study session on a resolution of intention to l~itiate rezoai~g of the area; that a conflict already exists and because of age of ho~es they may benefit from change of zone. It was moved by Councilman Brooks, seconded by Councilman Herrim amd carried, that Council approve the reclassification and instruct the City Attorney to prepare am amending ordinance according to E~hihit AA 558 A. HEARING - Nearing was opened om Amendment AA 561 - G~rLF OIL Applicatiom 561 filed by Gulf Oil Corp. proposing the amend- meat of Sectional District Map 6-5-9 by reclassifying from the R 1 to the C 5 district, property om the southeast corner of Grand and Santa Clara. pla~img Cvmmission Resolution 57~8 recrm~mended approval of E~hibit 561 B which would reclassify to the C 5 district all of the property except am approximate 150' x 150' at the corner. V. N. Je~sen, attorney representing the applicant, stated that the staff's concern over the corner had been alleviated by agreement to file a variance but it had been agreed that it should be approximately 125' x 125' instead of the 150' x 150' noted in the agenda. T~ere being no further testimony, the hearing was closed. It was moved by Councilman Burk, seconded by Councilman Brooks amd carried, that Council approve the reclassification amd instruct the City Attorney to prepare an amending ordinance according to ~hibit AA 561 B, except for Immediate corner of Grand amd Santa Clara which shall read 125' x 125'.
