RECESS <br /> <br />Council reconvened at 4:55 p.m. with-e~ <br />members present, and the Mayor declared <br />a recess to 7:30 p.m. <br /> <br />The meeting was reconvened at 7:30 p.m. in the Council Chambers, with the <br />same Councilmen present. Following the Pledge of Allegiance to the Flag, <br />the Invocation was delivered by the Reverend Everett Hezmall, Wilshire <br />Presbyterian Church. <br /> <br />CERTIFICAT~ OF <br />APPRECIATION <br /> <br />Mayor Harvey presented Certificates <br />of Appreciation to Messrs. William J. <br />Stauffer and Thomas Larsen for their <br />service on the Personnel Board. <br /> <br />ORD. NS-830 ORDINANCE NS-830 CHANGING DISTRICT <br />A.A. 550-VOSE CLASSIFICATIONS ON AMENDMENT APPLICATION <br /> NO. 550, FILED BY CLARA E. VOSE, AND <br /> AMENDING SECTIONAL DISTRICT MAP 2-5-10 <br />(EXHIBIT AA 550 A - REVISED) was read by title. The Mayor announced that <br />only testimony regarding legal technicalities of the hearing which was <br />closed would be heard, and called attention to the fact that two Councilmen <br />were absent. <br /> <br />John Parker, 1010 N. Main, attorney representing Santa Ann Homeowners <br />Association, stated that residents in the area had not been able to present <br />their arguments because of the many continuances, and asked for reopening <br />of the public hearing; concluding that he had not examined the proceedings <br />and could not comment on legal technicalities. <br /> <br />John Harvey~ attorney representing the applicant, commenting on the argument <br />that opponents were not adequately heard, observed that spokesmen, Holiday <br />and Cohen, had certainly spoken adequately; that the applicant could not <br />add to another hearing, and he doubted anyone else could without being <br />repetitious. <br /> <br />It was moved by Councilman Burk, seconded by Councilman Brooks, that further <br />reading be waived and Ordinance NS-830 be passed to second reading. <br /> <br />M~r. Parker stated that if the hearing was not going to be reopened it would <br />be to the disadvantage of the residents to have action taken when a full <br />Council was not present, and asked for a continuance. The Mayor replied <br />that at the next Council meeting representatives would be able to make their <br />presentations to a full Council and that holding first reading of the ordinance <br />was not a conclusive action. ~ne City Attorney added that tonight's discussion <br />was not a hearing but to determine if an error had been made in the proceedings. <br /> <br />The Mayor called for a voice vote and the motion to pass the ordinance to <br />second reading carried. Mayor Harvey invited Mr. Harvey and Mr. Parker to <br />come to the next meeting if they have any evidence pointing to a legal <br />defect in the proceedings. <br /> <br />HEA~ING - Hearing was opened on Amendment Application <br />A.A. 563 - KOCHAN 563 filed by M. L. Kochan proposing the <br /> amendment of Sectional District Map 9-5-10 <br /> by reclassifying from the R i to the C 5 <br />district, property on the east side ef LaBonita between Westminster and 16th <br />Street. Planning Commission Resolution 5753 recommended denial. <br /> <br />M. L. Kochan, applicant, stated that the Planning Commission decision had <br />been made because they did not wish the street to become commercial and <br />because of small lot size.
