PROPERTY DAMAGE Cb ~ The City Manager reported that during <br /> the storm, it had been necessary to <br /> intrude upon private property; that lawns <br />had been destroyed, patios cracked and fences broken, with and without owner's <br />consent. <br /> <br />Councilman Thurman was excused from the meeting at 5:10 P. M., du'e to a <br />conflict of interest. <br /> <br />The City Manager continued, stating that from any ethical standpoint there <br />was a City liability for damages, an opinion shared by the City Attorney; that <br />Compensation for damages which would not have occurred had the City not gone <br />into the property for the purposes of safeguarding and protecting it and <br />surrounding properties, would not be an illegal use of public funds; that he <br />recommended Council authorization to study the matter and to return to the <br />Council with a recommendation relative to compensation payments. <br /> <br />On motion of Councilman Griset, seconded by Councilman Brooks, the <br />recommendation of the City Manager was approved by the following roll call vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Herrin, Brooks, Griset, Markel, McMichael <br />None <br />Thurman <br /> <br />Councilman Thurman returned to the Council table. <br /> <br />SURPLUS BUILDING ~ ~ After considering Surplus Property Report <br /> 12-69 regarding one story residence at <br /> 519 West First Street, Council declared <br />the building surplus and authorized demolition, on motion of Councilman Herrin, <br />seconded by Councilman Thurman on the following roll call vote: <br /> <br />AYES: Herrin, <br />NOES: Markel <br />ABSENT: None <br /> <br />Brooks, Griset, Thur~an, McMichael <br /> <br />ASSEMBLY CONSTITUTIONAL <br />AMENDMENT 34 AND ASSEMBLY <br />BILL 1145 <br /> <br />On motion of Councilman Markel, <br />seconded by Councilman Brooks and <br />unanimously carried, the Clerk of the <br />Council was instructed to notify <br /> <br />Assemblyman Robert H. Burke of the Council's support of Assembly <br />Constitutional Amendment 34 and Assembly Bill 1145, dealing with the <br />rewording of the Loyalty Oath. <br /> <br />LEAGUE OF CALIFORNIA CITIES On motion of Councilman.Brooks, <br />SPECIAL DISTRICTS STUDY seconded by Councilman Griset and <br /> unanimously carried, the City Manager <br />was instructed to prepare a letter for the Mayor' s signature indicating the <br />Council's interest in the Special Districts Study for the purpose of governmental <br />simplification and to respond to the questions contained in the letter dated <br />April 1st, from Derek McWhinney, Chai~-~an of the Special Districts Committee. <br /> <br />CITY COUNCIL <br /> <br />169 April 7, 1969 <br /> <br /> <br />
