<br />'( . <br /> <br />" <br /> <br />) <br /> <br />Annual Compliance Tests <br /> <br />Tests in Response to Subscriber Complaints <br /> <br />Monthly Monitor Tests <br /> <br />Written records of test results shall be maintained, <br />and shall be available for Grantor inspection upon request. <br /> <br />(b) The tests for the cable system shall be <br />performed periodically, at intervals of no greater than <br />every six (6) months, on television receivers at a minimum <br />of twenty (20) locations, located throughout the service <br />area. At least eight (8) of these locations shall be at <br />the far end of the distribution trunk cables. The tests <br />shall be witnessed by representatives of the Grantor, and <br />written test reports shall be submitted to the Grantor. If <br />more than ten percent (10%) of the locations tested fail to <br />meet the performance standards, the Grantee shall be required <br />to indicate what corrective measures have been taken, and <br />the entire test shall be repeated for at least twenty (20) <br />different locations. If a second test results in failure of <br />more than ten (10%), the Grantor may at its sole option <br />reduce subscriber rates due to degraded service, unless the <br />circumstances of the failure are caused by conditions which <br />are beyond the Grantee's reasonable control or which are <br />not reasonably foreseeable. In imposing this penalty Grantor <br />shall comply with the provisions of Section 10.4 hereof. <br /> <br />SECTION 6. <br /> <br />SERVICES AND PROGRAMMING <br /> <br />6.1 Initial Services and Programming. Grantee shall <br />provide, as a minimum, the initial services and programming <br />listed in this section. If any listed service shall become <br />unavailable, or cannot be provided under existing FCC <br />regulations, Grantee shall provide substitute programming <br />considered at least as attractive to cable system subscribers. <br />Grantee shall not reduce the number of program services <br />without prior written notification to and approval by Grantor. <br />Grantor's approval shall not be unreasonably withheld and <br />its written decision shall be given to Grantee within thirty <br />(30) days from receipt of its notification. Grantee may add <br />new services at any time. Where the new services are services <br />which the Grantor may regulate, then those new services <br />shall be subject to Grantor approval of any new rate or rate <br />increase necessitated by the added service. Grantee may <br />combine programming into composite channels to improve ef- <br />ficiency of channel utilization or to attract a larger <br />viewing audience. <br /> <br />6.2 Basic Subscriber Television Services. Grantee <br />shall provide Basic Subscriber Television Services in three <br />(3) price tiers, as follows: <br /> <br />-20- <br />
