<br />, ' <br /> <br />"2.4 <br /> <br />Duration. <br /> <br />The term of the franchise shall be <br /> <br />fifteen (15) years from the effective date hereof unless <br />the option to extend is exercised by Grantee, at which time <br />it shall expire and be of no force and effect. Renewal <br />shall be in accordance with subsection 12.4 hereof." <br /> <br />4. <br /> <br />Subsection 4.2 of said agreement is hereby amended to <br /> <br />read as follows: <br /> <br />"4.2 <br /> <br />Construction Schedule. <br /> <br />(a) <br /> <br />Grantee shall extend its subscriber system to in- <br /> <br />clude service to all parcels within the City regardless of <br />designated or actual land use, subject to the conditions <br />and limitations contained herein. <br /> <br />(b) Grantee shall design and build the non-residentially <br />zoned areas of the City of Santa Ana subject to the follow- <br />ing conditions: <br /> <br />(1) Grantee shall map and design the ex- <br />tension of the subscriber system to all non-resi- <br />dentially zoned parcels and/or places of business <br />within the City within one (1) year from the date <br />of this agreement. <br /> <br />(2) The system shall be equivalent or <br />superior to that system serving the residential <br />areas of the City in terms of technical design, <br />capacity, and programming services. <br /> <br />(3) <br /> <br />Within two (2) years of the effective <br /> <br />date of this agreement, if Grantor so directs, <br />Grantee shall, at its own expense, conduct a <br />market study in a form and utilizing an independ- <br />ent consultant to be jointly selected by Grantee <br /> <br />-3- <br />
