For the purpose of the market study, <br />'Cumulative Aggregated Penetration Rates' shall <br />be determined by the number of subscribers will- <br /> <br />ing to commit to a one (1) year agreement to <br />receive cable television service with a minimum <br />three (3) month non-refundable deposit. <br /> <br />(4) Based upon the information and conclu- <br />sions contained in the market study described <br />above, if it is determined that Grantee is able <br />to achieve a cumulative aggregated penetration <br />rate of thirty-fiv~ percent (35%) of the poten- <br />tial subscriber base for any and all offered <br />services in these areas, and Grantee is able to <br />secure executed contracts from subscribers repre- <br />senting thirty-five percent (35%) cumulative <br />penetration and receive the required three (3) <br />month non-refundable deposit from said subscrib- <br />ers, then Grantee shall complete total construc- <br />tion of the non-residentially zoned areas within <br /> <br />twelve (12) months from the fulfillment date of <br />the above-specified conditions. Grantee shall <br />reimburse Grantor for all cost incurred, includ- <br />ing but not limited to staff time and consultant <br />costs, in inspecting and certifying completion of <br />the construction of the non-residentially zoned <br /> <br />areas of the City. <br /> <br />(5) <br /> <br />In the event that the first market <br /> <br />study does not project the penetration rates <br />delineated in subsection (4) above, Grantee shall <br />repeat its market study, subject to the same <br /> <br />-4- <br />
