' <br /> <br />On no less than a monthly basis, the Operator shall verify <br />achievement of the minimum performance specifications listed <br />above at no less than lB points in the system. Any monthly <br />maintenance test records will be maintained and available to the <br />City for review on a monthly basis between normal business hours. <br />Any monthly maintenance test records will be retained for 2 <br />years. During every yearly performance demonstration required <br />under this section, the Operator shall demonstrate compliance at <br />the furthest ends of each of the 4 major cascades and at no less <br />than B other points selected by the City. <br /> <br />PREVENTIVE MAINTENANCE <br /> <br />The Operator shall have the sole responsibility to develop, <br />maintain, and, update a written I-NET preventive maintenance <br />plan, and to carry out the provisions of the written preventive <br />maintenance plan. The plan shall be developed by the operator, <br />and a copy filed with the City, within 3 months of acceptance <br />of this agreement. The preventive maintenance shall be deemed <br />acceptable to the City if, by the system testing described above, <br />the Operator demonstrates compliance with the performance stand- <br />ards listed above. <br /> <br />DEMAND MAINTENANCE <br /> <br />In the event that the I-NET system, or any portion thereof, shall <br />fail to be operational, the Operator will provide the same <br />service to restore the I-NET as it does for the subscriber network, <br />except as follows: In the event City indicates and has an immedi- <br />ate need for I-NET system operation for scheduled police or fire <br />training and the I-NET fails to operate, the Operator will respond <br />for service within two (2) hours of Notice if Notice is given <br />during normal business hours. In such event, the Operator shall <br />take all reasonable measures to restore operation within four (4) <br />hours of notice of nonoperation unless it is physically impossible <br />to repair within the stated time period. <br /> <br />The Operator will be solely responsible for the technical perform- <br />ance and required repairs of the I-NET system, as set forth below, <br />hereafter referred to as the point of demarcation: <br /> <br />Prior to installing any new I-NET service and consistent with <br />the next two paragraphs below, City and Operator will jointly <br />identify and agree on the point of demarcation for such new service. <br /> <br />Downstream - From the point of transmission, inclusive of <br />all Operator owned processing equipment, to the end of the users <br />coaxial feed cable, and/or the output of the operator owned <br />terminal device. <br /> <br />Upstream - From the coaxial feed point connection between <br />the users transmission device excluding the said device itself to <br />the termination point. <br /> <br />-4- <br />
