<br />" . <br /> <br />franchise fee to which Grantor is entitled. <br /> <br />"Grantee shall only generate local origination, public <br /> <br />access and government access programming on KCTY (Channel 3) <br /> <br />of the type and kind traditionally provided on government <br /> <br />and local origination cable channels in the County of Orange, <br /> <br />State of California. <br /> <br />Any deviation from the foregoing <br /> <br />standard shall only be with the written approval of Grantor's <br /> <br />City Manager or his or her delegate, which approval shall <br /> <br />not unreasonably be withheld." <br /> <br />6. <br /> <br />Subsection 7.3 of said agreement is hereby amended to <br /> <br />read as follows: <br /> <br />"7.3 Special Programming <br /> <br />"Grantee, at its own cost and expense, shall provide <br /> <br />special programming at Grantor's request in the aggregate <br /> <br />cost of $52,000 between the date of this agreement and <br /> <br />expiring four (4) years thereafter. <br /> <br />As used herein, <br /> <br />"special programming" includes, but is not limited to, <br /> <br />equipment set-up, duplication, and/or event coverage. <br /> <br />Upon <br /> <br />exhaustion of the $52,000 grant herein, Grantee shall pro- <br /> <br />vide special programming at Grantor's sole cost and expense. <br /> <br />Such special programming shall be provided at the rates <br /> <br />then in effect which Grantee charges its most favored <br /> <br />commercial customer. <br /> <br />Grantor shall provide written notice <br /> <br />to Grantee at least fifteen (15) working days prior to <br /> <br />special programming desired by Grantor. <br /> <br />Grantee agrees <br /> <br />that the cost of such special programming shall not be <br /> <br />included as part of any franchise fee to which Grantor is <br /> <br />-8- <br />
