PUBLIC HEARING - APPEAL 232 <br />CUP 70-2 - LIGHTFOOT (continued) <br /> <br />Arthur J. Bilava (continued) <br />health, safety and general welfare of the persons residing in the <br />vicinity; that no use was specified in the Municipal Code for horse <br />shows; and that the conditional use permit would adversely affect <br />the General Plan since the area was designated for medium <br />residential use; <br /> <br />Mrs. Oliver Peterson, 4718 W. 5th Street, who stated that they <br />were not opposing the animals, but that they could not open their <br />doors, hang clothes, etc. because of the dust and that the dust <br />was harmful to her heart and emphysema conditions; <br /> <br />Wanda Goddard, 4714 W. 5th Street, who stated that the dust <br />adversely affected the health of her granddaughter who lives <br />with her and has asthma; <br /> <br />Mr. Rose, 4626 W. 5th, who objected to the dust from the horse <br />shows and from the unpaved parking lot; <br /> <br />Oliver Peterson, 4718 W. 5th Street, the appellant, who objected <br />to the dust and stated that two letters were on file with the Planning <br />Commission objecting to the conditional use permit and they were <br />not read at the Planning Commission meeting; at the Mayor's request, <br />the Clerk of the Council read aloud the two letters on file from <br />Albert Adams, 2301 S. Shelton and from Lorene 1Rickard, 4726 W. <br />5th Street, objecting to the flies and dust from the stable; <br /> <br />Jim Scheuneman, who expressed the opinion that there should be no <br />horses in the area, since they were being ridden on the streets; <br /> <br />Albert Adams, 2301 S. Shelton, also spoke. <br /> <br />The following persons spoke in opposition to the appeal: <br /> <br />Wallace Cloud, 2721 N. Laird Street, who explained that one <br />of the conditions in the use permit was that the dust factor be <br />curbed and that a process of oiling was being done at the present <br />time that would take care of the dust problem when it was completed, <br />He stated that a dairy was west of the subject property, directly <br />to the south was a chicken ranch, another stable was southeast <br />of the property, and to the east was Mr. Peterson's property; <br />that Mr. Peterson kept horses and dogs on his property, creating <br />dust; that only two horse shows had been held since July 1, 1969, <br />and that the cars all parked in the arena area; and that the home <br />owners on the north side of the street had no objection to this stable; <br /> <br />Jack Lightfoot, 202 S. Newhope, the applicant for the conditional use <br />permit and owner of the stable, explained that dumpsters came in <br />three times a week to take away the manure so that was not a problem <br />and that the dust problem was being taken care of by the oil processing. <br /> <br />CITY COUNCIL -112- April 20, 1970 <br /> <br /> <br />
