Frank Bueche, 2009 E. Edinger, representing National Land Development <br />Company, spoke in favor of the proposed rezoning. He explained that his <br />company had previously applied for rezoning of the subject property to R 4 , <br />which had been denied, so they were now proposing to step-down the <br />zoning to R I and R 2 which they felt was compatible with the surrounding <br />neighborhood. <br /> <br />Mrs. Judith Zander, 2611 Linwood Avenue, spoke in opposition to the proposed <br />rezoning, stating that this would increase the density in the area from medium <br />to high density; also that there was a shortage of park land for the present <br />population regardless of any future development. She explained that the <br />residents in the area would be satisfied with R I zoning for all of the subject <br />property. <br /> <br />The hearing was closed. <br /> <br />After discussion by Council, it was moved by Councilman Herrin, seconded by <br />Councilman Evans, to approve Amendment Application 672 and instruct the City <br />Attorney to prepare an ordinance to reclassify the property according to <br />Exhibit A. The motion passed on the following roll call vote: <br /> <br /> AYES: Herrin, Evans, Markel, Patterson, Villa, Yamamoto, Griset <br /> <br /> NOES: None <br /> ABSENT: None <br /> <br />APPEAL 247 - VA 70-41 <br />STEPHENS <br /> <br />Hearing was opened on Appeal 247, filed <br />by Walter M. Beckman, appealing Planning <br />Commission's approval on September 14, <br /> <br />1970 of Variance Application 70-41, filed by Gene J, Stephens, to construct a 2 <br />story, 116 unit garden apartment complex in the R 1 District at 4818 W~ McFadden. <br /> <br />Walter Beckman, 5002 W, McFadden, the appellant, explained to Council that he <br />owned the property to the west of the proposed development, his property being <br />a mobile home park, and that a school was situated on the other side. He stated <br />'his main concern was overcrowding of the schools in the district, since a 191 <br />space mobile home park is presently under construction in the area; another <br />concern was high density; he further stated that with the R 1 homes in the <br />surrounding area, this property should be developed as residential and thai <br />granting of the subject variance would be contrary to the City's General Plan~ <br /> <br />Warren Proctor, 115 West 15th Street, agent for the buyer and seller, spoke <br />against the appeal. Mr. Proctor explained that an intermediate school is to <br />the east of the proposed development, an established tract with no street to this <br />particular parcel is to the south, Mr, Beckman's mobile home park is to the <br />west, and across the street the property is already developed with a church and <br />some older properties. He stated that it would be difficult to develop the property <br />as R 1 because it has to be developed within its own boundary lines because fhere <br />is no other access. <br /> <br />The hearing was closed. <br /> <br />It was moved by Councilman Villa, seconded by Councilman Herrin, to uphold <br />the action of the Plarming Commission and instruct the City Attorney to prepare <br />a resoltuion granting Variance Application 70-41 subject to conditions in Finding <br />of Fact dated September 14, 1970.
