PUBLIC HEARING Upon the request of the <br />APPEAL NO. 321 applicant for a continuance, <br />ALLAN FAINBARG the public hearing on <br /> Appeal No. 321, filed by <br />Allan Fainbarg appealing provision 6A (4) of the Planning <br />Co~nission's Findings of Fact dated June 26, 1973, relating to <br />Variance Application 73-31, to reduce the required 10 feet <br />rear yard setback to 0 feet for an office building in the R lB <br />and C 5 Districts; also to waive the Code requirement for on-site <br />vehicular circulation between parking areas, was continued to <br />the Regular Meeting of August 20, 1973, on motion of Councilman <br />Griset, seconded by Councilman Evans, and unanimously carried <br />on a 6 - 0 vote. (CA 13.3) <br /> <br />PUBLIC HEARING The Mayor opened the public <br />APPEAL NO. 322 hearing on Appeal No. 322, <br />FOX & CARSKADON filed by Fox & Carskadon <br /> Financial Corporation, <br />appealing the Zoning Administrator's denial of Minor Exception <br />73-17, to reduce required parking for a retail use from 26 <br />spaces to 21 spaces, in the C 1 District, at 322 W. 17th Street. <br /> <br />The Planning Director summarized the Zoning Administrator's <br />report dated July 20, and the Addendum for Minor Exception <br />73-17 - Appeal 322. He stated that some relief had been <br />granted to the health food store on the adjoining lot, and <br />Council might wish to grant relief to the applicant; however, that <br />a twenty per cent waiver is very high; that modification of the <br />building in size, shape or location could provide the required <br />parking space. <br /> <br />Dave Legters, Legters Realty, 565 E. Holt Avenue, representing <br />Fox and Carskadon, spoke in favor of the appeal. He stated <br />that Color Tile, Inc. would enter into a 15 year lease for the <br />building; that due to the nature of the business 21 spaces would <br />be more than adequate for the proposed use; that the building <br />would be attractive and improve the property; that the proposed <br />use would cause no traffic or parking problems; that all other <br />Code requirements had been met or exceeded; that additional <br />parking would only increase the amount of blacktop. <br /> <br />Dr. Forest Moody, part owner of the property, spoke in favor of <br />the appeal. He stated that the widening of 17th Street had <br />created a hardship for the owners in that it shortened the lots, <br />and that two lots had been combined to find a solution to the <br />problems. <br /> <br />There were no written communications; there were no other pro- <br />ponents and no opponents; and the Mayor closed the public hearing. <br /> <br />On motion of Councilman Ward, seconded by Councilman Markel, <br />Council overruled the decision of the Zoning Administrator and <br />granted the appeal and approved Minor Exception 73-17, subject <br />to Planning Director's conditions contained in Addendum dated <br />August 1, 1973, on the following vote: <br /> <br />AYES: Ward, Markel, Griset, Evans, Yamamoto <br /> <br />NOES: Patterson <br /> <br />ABSENT: Garthe <br /> <br />CITY COUNCIL MINUTES <br /> <br />296 <br /> <br />AUGUST 6, 1973 <br /> <br /> <br />
