County of San Joaquin <br />equal to or greater than the cost currently available in the State contract will be <br />immediately rejected. <br />• Proposers shall not establish a minimum purchase volume as a condition of any <br />aspect of their proposal. However, San Joaquin County will accept proposals that <br />list additional discounts that will be provided to all Counties and Cities, should a <br />certain volume of sales be reached. <br />• Proposals must provide a provision that allows Counties and Cities to cease their <br />existing contract/agreement with McAfee, Symantec or Trend Micro with no <br />penalty, if they initiate continued licensing/service with the same vendor through <br />the procurement vehicle created by this RFP. <br />• Proposals must provide Counties and Cities with any and all costs associated with <br />software maintenance and upgrade protection. The price shall be provided on a <br />per unit basis, and define the period of coverage (1 year, 2 years, 3 years, <br />perpetual). The proposal shall also define a cap on the percentage of annual cost <br />increase that can occur in these areas. <br />• Proposals shall describe in detail the technical assistance services that will come <br />standard with the anti -virus licenses /subscriptions acquired via this contract. If <br />differing levels of service are available, proposals must identify each service level <br />by name, describe the services available at each level, and define the annual cost <br />of each respective level. The proposal must define, at a minimum, the number of <br />County /City staff that can call the technical support line, the days and hours of <br />service, guaranteed response times, escalation policies, and whether or not the call <br />is toll -free. <br />• Proposals shall not exceed 10 pages in length. <br />6 Contract Terms & Conditions <br />• 6.1 General Contractual Requirements <br />The County will prepare and negotiate its own contract with the proposer, giving due <br />consideration to the stipulation of the proposer's standard contracts and associated legal <br />documents. The proposer needs to address the specific languages referenced and submit <br />whatever exceptions or exact agreement modifications that it may have to the proposed <br />terns and conditions. <br />The forgoing should not be interpreted to prohibit either party from proposing additional <br />agreement terms and conditions during negotiation of the final agreement. The award of <br />this RFP is predicated upon the successful negotiation of a contract between San Joaquin <br />County and Proposer. <br />G7 <br />
