<br />complete written response, additional material, such as technical documents, may be referenced in any <br />response, if the material is included in the same section as additional information. <br /> <br />6. Proposals are not to be marked as confidential or proprietary. Proposals submitted in response to this RFP are <br />subject to public disclosure as permitted by the California Public Records Act. Additionally, all proposals shall <br />become property of the City. The City reserves the right to make use of any information or ideas in the proposals <br />submitted. <br /> <br />7. By submitting a proposal, the Offeror represents that it has thoroughly examined and become familiar with the <br />services required under this RFP, and that it is capable of providing the services to achieve the City's objectives. <br /> <br />8. Each Offeror must submit its proposal in strict accordance with all requirements of this RFP and compliance must <br />be stated in the proposal. Deviations, clarifications and/or exceptions must be clearly identified and listed <br />separately as alternative items for the City's consideration. <br /> <br />9. Each Offeror is encouraged to be responsive to the requirements stated in this RFP. If, however, any Offeror <br />feels that it can offer substantial cosVbenefit and/or perfonnance advantages, the City will consider and may <br />accept alternate Proposals. Alternate Proposals must specify how they deviate from the requirements and <br />describe the cost reduction and other benefits to be achieved. Alternate Proposals must meet or exceed the <br />intent of this RFP and must be submitted as separate Proposals clearly marked" Aiternate" on the outside cover. <br /> <br />10. After the closing date and time for receipt of proposals, evaluation will commence. Offerors who submit <br />proposals most responsive to the City's requirements may be asked to give an oral presentation of their proposal <br />to Staff. Selected Offerors should be prepared to make their oral presentation within three calendar days after <br />notification and be prepared to discuss all aspects of their proposal in detail, including technical questions <br />regarding the proposal. Offerors shall not be allowed to alter or amend the proposal through the use of the <br />presentation process. <br /> <br />11. Any proposal may be rejected if it is conditional, incomplete or deviates from specifications in this request. <br /> <br />12. Pre-contractual expenses are not to be included in the Compensation for Contractor Services. Pre-contractual <br />expenses are defined as expenses incurred by the Offeror in: a) preparing its proposal in response to this RFP; <br />b) submitting that proposal to the City; c) attending meetings for the award of the contract; and d) any other <br />expenses incurred by the Offeror prior to the date of award and execution; if any, of the AGREEMENT. Offeror <br />will be required to attend the Redevelopment and Housing Commission meeting and City Council meeting for the <br />award of the contract. However, these expenses cannot be included in the Compensation for Contract Services. <br /> <br />13. The City reserves the right to: a) withdraw this RFP at any time without prior notice and furthermore, make no <br />representations that any Contract will be awarded to any Offeror responding to this RFP; or b) award its total <br />requirements to one Offeror or to apportion those requirements among two or more Offerors as the City may <br />deem to be in its best interest. The proposal submitted should contain the Offerors most favorable terms and <br />conditions, since the selection and award may be made without discussion with any Offeror. <br /> <br />14. Where two or more Consultants desire to submit a single proposal in response to this RFP, they should do so on <br />a prime/subcontractor basis rather than a joint venture. The City intends to contract with a single firm or multiple <br />firms but not with multiple finns doing business as a joint venture. <br /> <br />B. <br /> <br />Criteria for Selection <br /> <br />Substantial consideration will be given to consultants with demonstrable and documented experience in similar work. <br />Responses will be evaluated on the merit of qualifications, abilities and responsiveness of the proposing firms. <br />
