Assistant Planning Director Bill Daugherty reviewed the Zoning Administrator's Finding of Fact dated August 6, 1974, and the two basic reasons for denial of the Minor Exception: 1) Police problems in the area; and 2) Noise complaints from area residents. Mr. Daugherty assured Council that there is no basis for Mr. Heinly's allegation that Mr. Johnson was being unfairly treated. Herman Johnson, 1305 West Fourth Street, stated that his restaurant has been open for a year without trouble; that serving beer with meals will not create additional Police problems; that he is willing to accept any conditions imposed by Council as to hours of operation; and suggested a one year time limit, with extension subject to Council approval. The Assistant Clerk read the following noise complaints from area residents: 1. Letter from Margarita de la Riva; 2. Letter from Mrs. Mary Ruiz. There were no other written communications, and no other proponents or opponents, and the Mayor closed the Public Hearing. Following Council discussion, the motion of Councilman Yamamoto, seconded by Councilman Griset, to receive and file the Determina- tion of Exemption and instruct the City Attorney to prepare a resolution upholding the decision of the Zoning Administrator to deny Minor Exception 74-17, carried with dissenting votes by Councilmen Evans and Garthe, and Mayor Patterson. (CA 13.5) PUBLIC HEARING RESOLUTION 74-115 - VACATION OF ALLEY A RESOLUTION OF THE BETWEEN CENTRAL & HEMLOCK CITY COUNCIL OF THE CITY OF SANTA ANA ORDERING THE VACATION OF A PORTION OF A NORTH-SOUTH ALLEY LOCATED BETWEEN CENTRAL AVENUE AND HEMLOCK WAY AND RESERV- ING EASEY~ENTS OVER THE SAME was continued to September 9, 1974, pending completion of a Variance, on motion of Council- man Yamamoto, seconded by Councilman Evans, and carried unanimously. Prior to the vote, the Mayor asked for any objections to continuance from the audience, and there were none. (CA 14) RECESS present. A recess was declared at 8:30 P.M. Council reconvened at 8:42 P.M. with all Councilmen PUBLIC HEARING The Mayor opened the ONE-WAY STREET Public Hearing to POINSETTIA consider restriction of traffic on Poinsettia Street to southbound movement only between Fourteenth Street and Washington Avenue. Traffic Engineer Joe Foust reported orally to identify the problems; to summarize neighborhood response to a question- naire survey contained in the report dated July 29, 1974 from the Director of Public Works; and to recommend approval of the proposal.
