Assistant Planning Director Bill Daugherty reviewed the Zoning <br />Administrator's Finding of Fact dated August 6, 1974, and the <br />two basic reasons for denial of the Minor Exception: 1) <br />Police problems in the area; and 2) Noise complaints from <br />area residents. Mr. Daugherty assured Council that there is <br />no basis for Mr. Heinly's allegation that Mr. Johnson was <br />being unfairly treated. <br /> <br />Herman Johnson, 1305 West Fourth Street, stated that his <br />restaurant has been open for a year without trouble; that <br />serving beer with meals will not create additional Police <br />problems; that he is willing to accept any conditions imposed <br />by Council as to hours of operation; and suggested a one <br />year time limit, with extension subject to Council approval. <br /> <br />The Assistant Clerk read the following noise complaints <br />from area residents: <br /> <br />1. Letter from Margarita de la Riva; <br /> <br />2. Letter from Mrs. Mary Ruiz. <br /> <br />There were no other written communications, and no other <br />proponents or opponents, and the Mayor closed the Public Hearing. <br /> <br />Following Council discussion, the motion of Councilman Yamamoto, <br />seconded by Councilman Griset, to receive and file the Determina- <br />tion of Exemption and instruct the City Attorney to prepare a <br />resolution upholding the decision of the Zoning Administrator <br />to deny Minor Exception 74-17, carried with dissenting votes <br />by Councilmen Evans and Garthe, and Mayor Patterson.
