The decision of the Zoning Administrator to deny the appli- <br />cation was overruled, and the City Attorney was instructed <br />to prepare a Resolution granting Minor Exception No. 75-5, <br />for adoption by the Council at its next meeting, April 21, <br />on motion of Councilman Bricken, seconded by Councilman <br />Ortiz and carried on the following roll call vote: <br /> <br />AYES: Bricken, Ortiz, Garthe, Ward <br /> <br />NOES: Brandt, Evans, Yamamoto <br /> <br />ABSENT: None <br /> <br />CA 13.5 <br /> <br />RECESS <br /> <br />at 8:35 P.M., with all Council members <br /> <br />Mayor Garthe <br />declared a recess <br />at 8:30 P.M.; <br />Council reconvened <br />present. <br /> <br />17TH STREET MEDIAN A petition with <br /> 285 signatures, <br /> requesting recon- <br /> sideration of the <br />recent Council action approving the construction of a <br />raised center divider on Seventeenth Street between Main <br />and Ross Streets, was read aloud by the Clerk of the <br />Council. It was filed with the Clerk by Mr. Wade Herrin <br />on behalf of the property owners on and near Seventeenth <br />Street. <br /> <br />The City Attorney, responding to Mayor Garthe's request <br />for a legal ruling on the reconsideration request stated <br />that the request was related to another item on the Agenda, <br />Project 1345 bid award; that the Project for the widening <br />of Seventeenth Street, between Ross and Main, had been <br />bid with the. median and without the median; that Council <br />could award to the low bidder in either case; and there- <br />fore the question of legality of the reconsideration is <br />moot. <br /> <br />Mr. Wade Herrin, 1505 North Baker, representing the peti- <br />tioners, stated that all of the property owners and mer- <br />chants in the area were opposed to the median; that to his <br />knowledge, no previous Council had ever seen fit to override <br />a 100 per cent protest; that the Fire Chief and Police <br />Chief should provide input regarding the effect a median <br />would have on service of emergency vehicles. <br /> <br />Fire Chief Judd stated that he was not opposed to the con- <br />struction of this particular median; however, that medians <br />do hinder access to fire apparatus and sometimes result in <br />the loss of precious minutes in arriving at the scene of a <br />fire. <br /> <br />Police Chief Davis stated that he had no major objections <br />to medians if they are properly designed and traffic flows <br />have been evaluated. <br /> <br />Mr. Herrin suggested that adoption of a traffic control pat- <br />tern similar to that on East 17th Street on the east side of <br />Grand Avenue should be given consideration. <br /> <br />CITY COUNCIL MINUTES 144 APRIL 14, 1975 <br /> <br /> <br />
