Charles Zimmerman, Planning Director, stated that the Planning <br />Commission had unanimously denied the Variance Application <br />because the Commissioners felt that it was an intrusion into <br />a fine, well-established residential neighborhood in the north- <br />west area of the City; that the Applicant requested waiver <br />of six off-street parking spaces which would be required; that <br />there is no on-street parking; and that the City offers many <br />fine professional areas from which to choose for the location <br />of his practice. <br /> <br />Dr. David Wilson, Appellant, stated that the location is situated <br />at Broadway and Santa Clara, a major commercial intersection; <br />that the other three corners are commercial; that he wishes <br />to make no structural changes whatsoever; that he just wishes <br />to see a few patients in his home; that there are parking <br />spaces on Santa Clara, and space in his back yard; that he <br />will use no signs; and there will be no way to tell how it is <br />used; that this is a unique location, a buffer property; that <br />there are 15,000 cars passing the intersection daily; and <br />that he requests that the Variance be granted to him personally, <br />so that when the property is sold it would revert back to <br />residential. He filed a letter from his neighbors at 2310 <br />North Park Boulevard, Helge and Mary Harvest, stating that they <br />do not object to his professional practice. <br /> <br />The following persons spoke in opposition to the Appeal and the <br />Variance: <br /> <br />Richard Longshore, 2314 North Park Boulevard <br />Herbert Hansen, 2315 Bonnie Brae <br />Mildred Spicer Collins, 2348 North Park Boulevard <br />George Hanna, 2221 Victoria Drive <br />Louis Pecora, 2438 North Park Boulevard <br /> <br />The opponents stated that if this building is allowed to be <br />used for commercial purposes that it will open the door to <br />many more such applications; that they take pride in this fine <br />residential neighborhood, and they do not wish infringement <br />upon it; and that they do not wish to have a parking lot in <br />their neighborhood. <br /> <br />In rebuttal, Dr. Wilson stated that he sees six patients a day <br />on the average; and that he is willing to stipulate for the <br />record to limited professional use of the property. <br /> <br />There being no further speakers, and no other written communica- <br />tions, the Mayor closed the Public Hearing. <br /> <br />On the motion of Councilman Evans, seconded by Councilman Ortiz, <br />and carried (6:1) with Councilman Yamamoto dissenting, the <br />Negative Declaration No. 7S-178 was approved and filed, and <br />the following Resolution affirming the action of the Planning <br />Commission was adopted: <br /> <br />RESOLUTION NO. 76-27 - A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA AFFIRMING THE <br />ACTION OF THE PLANNING COMMISSION ON VARIANCE <br />APPLICATION NO. 75-68, DENYING SAID VARIANCE APPLI- <br />CATION, AND DENYING APPEAL NO. 360 FILED THEREON <br />BY DAVID H.
