PUBLIC HEARING - APPEAL 382 Mayor Evans announced <br />MINOR EX 77-25 - 2530 W. CENTRAL that this was the time <br />CONTINUED TO OCT. 17 and place for the public <br /> hearing of Notice of <br />Exemption and Appeal #382 of the denial of Minor Exception <br />77-2S to allow a 12-foot high chain link fence for a recrea- <br />tional court in the rear yard of the residence at 2S30 West <br />Central Avenue in the R1-PRD District. <br /> <br />Senior Planner William Daugherty stated that the minor excep- <br />tion would allow a fence to remain that is in excess of the six <br />foot height permitted in a rear yard setback; that the fence <br />is in conjunction with a basketball court; that there are two <br />lights for evening activities; that the application was filed <br />due to a complaint which had been received by a property owner <br />south and west of the subject property at 2530 Central Avenue; <br />that the General Plan indicates low density residential for the <br />area; and that the application was denied by the Zoning Admin- <br />istrator on September 9, 1977. <br /> <br />The applicant, John Devers, stated that he had not completed <br />the planned landscaping which would improve his yard a great <br />deal; that the fence was constructed to prevent the balls from <br />going into other yards; that three neighbors had given their <br />verbal approval; and that he had not applied for a minor ex- <br />ception because he had expected the contractor to take care <br />of that matter for him. <br /> <br />There being no further speakers, the Mayor closed the public <br />hearing. <br /> <br />Councilman Brandt moved to grant Appeal #382 of the denial of <br />Minor Exception 77-25 which was seconded by Councilman Ward. <br />Following Council discussion a motion to amend the motion to <br />require certain landscaping and the redirection of the lighting <br />was made by Councilman Ward, seconded by Councilman Bricken <br />and carried 5:1, with Councilman Yamamoto dissenting. The <br />subsequent vote on the main motion to grant Appeal #382 of <br />the denial of Minor Exception 77-25 failed to carry on a 3:3 <br />tie vote, with Councilmen Garthe, Yamamoto and Mayor Evans <br />dissenting. <br /> <br />A motion to continue the matter to October 17, 1977, made by <br />Councilman Ward, seconded by Councilman Bricken, carried <br />6:0 unanimously. The continuance would allow Councilman <br />Ortiz to listen to the taped hearing and participate in the <br />vote. CA 13.5 <br /> <br />PUBLIC HEARING - PARKING Mayor Evans announced <br />RESTRICTION ON WASHINGTON AVE. that this was the time <br />RESOLUTION REQUESTED and place for the public <br /> hearing of the removal <br />of parking on Washington Avenue between Main and Lincoln <br />Streets, which had been set by the City Council on September <br />6, 1977. <br /> <br />Director of Public Works John Stevens, referring to a report <br />prepared by Joe Foust, Traffic Engineer, dated August 30, <br />1977, stated that the parking res%rictions recommended were <br />developed, through the discussions of the Logan Community <br />Task Force, to satisfy traffic circulation in and around the <br />area; that Washington Avenue is a 33-foot wide street which <br />serves as a collector-type arterial; that the traffic volume <br />is 5,800 vehicles per day; and that although the volume is <br />not high, the narrowness of the street presents a difficult <br />driving situation, particularly with parking on both sides. <br /> <br />CITY COUNCIL MINUTES <br /> <br />361 OCTOBER 3, 1977 <br /> <br /> <br />
