HARBOR BOULEVARD hearing to consider Negative <br />APPROVED Declaration and Conditional <br /> Use Permit No. 79-15 to <br />allow retail sales of cameras and equipment in the M 1 District, <br />generally located on the southwest corner of Harbor Boulevard and <br />Warner Avenue. <br /> <br />The Planning Director summarized the staff analysis contained in the <br />Finding of Fact report dated June 18, 1979. <br /> <br />The Deputy Clerk of the Council reported there were no written communications. <br /> <br />Martin Cohen, Attorney, 540 Golden Circle Drive, Santa Arm, represent- <br />ing the applicant, spoke in favor of the proposal. <br /> <br />There were no other speakers. The Mayor closed the public hearing. <br /> <br />Following discussion, ~DTION was made by Luxembourger, seconded by Griset, <br />to approve and file the Negative Declaration and instruct the City <br />Attorney to prepare a resolution granting Conditional Use Permit No. <br />79-15, affirming the decision of the Planning Commission, subject to the <br />requirements contained in the Planning Commission Finding of Fact, <br />and the additional requirements that retail use be limited to 1,000 <br />square feet of the total area, that signing be limited to identification <br />only, and that retail sales hours be limited to Monday through Saturday <br />from 8:00 a.m. to 5:00 p.m. <br /> <br />AYES: <br />NOES: <br /> <br />GRISET, L~OURGER, WARD, YAMAMOTO <br />BRICK~N, MARKEL, SERRATO <br /> <br />CA 13.4 <br /> <br />PUBLIC HEARING - APPEAL NO. 404 The Mayor announced that this <br />CUP 79-7 - 2701 N. BROADWAY was the time and place for the <br />DENIED continuation of the public <br /> hearing for consideration of <br />Notice of Exenrption and Appeal No. 404' of the Planning Conmission denial <br />of Conditional Use Pemit No. 79-7 to allow construction of forty <br />condominim~s in the P District at 2701 North Broadway, continued from <br />July 16, 1979. <br /> <br />The Senior Planner reviewed the staff analysis contained in the Planning <br />Commission Finding of Fact dated May 29, 1979, and sunmmrized the report <br />dated July 9, 1979, prepared bY the Transportation and Traffic Engineer. <br /> <br />Robert Mickelson, 2823 Casselle Avenue, Orange, representing the appellant, <br />spoke in favor of the proposal. MickeyMadden, 2319 North Rosewood, spoke <br />in opposition. <br /> <br />There were no other speakers. The Mayor closed the public hearing. <br /> <br />Following discussion, the MOTION made by Yamamoto, seconded by Bricken, to <br />approve and file the Notice of Exemption and instruct the City Attorney <br />to prepare a resolution granting Appeal No. 404, overruling the decision <br />of the Planning Commission and granting Conditional Use Permit No. 79-7 <br />subject to the requirements contained in the Planning Commission Finding <br />of Fact and the following added requirements: 1) There shall be "No <br />Stopping Any Time - Tow Away" on the Broadway frontage of the property; <br />and 2) Access to the property shall be designated as one-way traffic <br />through pavement markings and signs installed by developer such that the <br />southerly driveway shall be the entrance and the northerly driveway shall <br />be exit only, FAILED to carry on the following vote: <br /> <br />AYES: <br />NOES: <br /> <br />BRICKEN, YAMAMOTO <br />GRISBT, LID(EMBOURGER, MARK~L, SERRATO, WARD <br /> <br />CITY COUNCIL MINUTES <br /> <br />273 AUGUST 6, 1979 <br /> <br /> <br />
