<br />. <br /> <br />(b) Reduction of Walls. The reduction of all walls, <br />including foundation walls, to the surface eleva- <br />tion of the adjoining ground. <br /> <br />(c) <br /> <br />Breaking Up Basement Floors. <br />all basement or cellar floors <br />mit property drainage. <br /> <br />(d) Filling and Grading. Such filling, grading, and <br />leveling of the land (but not including topsoil <br />or landscaping) as will permit proper drainage <br />and place the Property in a safe, clean, sanitary, <br />and nonhazardous condition. <br /> <br />The breaking up of <br />sufficiently to per- <br /> <br />. <br /> <br />(e) Filling Materials. The filling of all basements <br />or other excavations exposed as a result of the <br />work performed by the Agency pursuant to this <br />Section, with noncombustible materials to a level <br />twelve (12) inches below the surface of the ad- <br />joining ground on all sides thereof. <br /> <br />As a condition subsequent to this Agreement Redeveloper <br />has a right to terminate this Agreement, if all public utility <br />lines, installations, facilities, and related equipment within <br />or on the Property have not been removed or abandoned by the <br />time set forth in the Schedule of Performance, Attachment <br />No.3. <br /> <br />. <br /> <br />The Agency, or the appropriate Public body, shall remove <br />all paving, including catch basins, curbs, gutters, streets <br />and drives (sidewalks to remain) within or on the Property. <br />In addition the Agency shall be responsible for the correction <br />or cure of any undiscovered man-made defects in the soil, but <br />will make no guarantee of the quality of the soil. As to all <br />other portions of the Property including the soil beneath the <br />,areas excavated by the Agency, the Property shall be conveyed <br />in an as is condition. It shall be the sole responsibility of <br />the Redeveloper at Redeveloper's expense to investigate and <br />determine the soil condition and the suitability of the Proper- <br />ty for the development to be constructed. If the soil condi- <br />tion of the Property is not in all respects entirely suitable <br />for the use or uses to which the Property will be put, then <br />:, it is the sole responsibility and obligation of Redeveloper to <br />. take such action as may be necessary to place the Property and <br />the soil condition of the Property in all respects in a condi- <br />tion entirely suitable for the development of the Property. <br /> <br />.. ;.. :~ ' <br /> <br />- 17 - <br />
