<br />the January 15, 2004 or the March 18, <br />2004 meeting. <br /> <br />(ii) As discussed above, this project is not <br />within either the 65 dB (A) CNEL noise <br />contour or the 60 dB (A) CNEL noise <br />contour. <br /> <br />(iii) The contract acoustical consultant for <br />JWA, Mr. Vince Mestre of Mestre-Greve <br />Associates, testified at the January 15, <br />2004 ALUC meeting that when all <br />factors are considered the noise level <br />will be higher at the ground level of the <br />building rather than at the roof of the <br />building. <br /> <br />(iv) Synectecology states in the noise study <br />prepared for Geneva Commons <br />development dated August 14, 2003, <br />"The project site is located <br />approximately 1.5 miles northwest of the <br />John Wayne International Airport. The <br />project is located to the west of the <br />established flight path and is beyond the <br />airport's 60-dBA CNEL noise contour. <br />Implementation of the proposed project <br />would not expose the new residents to <br />excessive aircraft noise levels and no <br />mitigation measures are necessary." <br /> <br />(v) Moreover, any possible noise issues will <br />be sufficiently mitigated by the following <br />mitigation measures such as: <br /> <br />. <br /> <br />The Notice of Airport in the <br />Vicinity" will be recorded on the <br />deed for each residential unit and <br />shall remain so recorded so long <br />as the airport is in operation. <br /> <br />. <br /> <br />The construction of the units will <br />exceed the State-recommended <br />45 dB (A) CNEL interior standard <br />by being conditioned under the <br />Conditional Use Permit to have <br /> <br />75C-290 <br /> <br />Resolution No. 2005- <br />Page 15 of 25 <br /> <br />
