<br />"Access" or "PEG Access" or "PEG Use" means the availability of the cable <br />system, under Grantor's control, for noncommercial use by various agencies, institutions, <br />organizations, groups, and individuals in the community, including Grantor and its designees, to <br />acquire, create, receive, and distribute video and other signals as permitted under applicable law, <br />including, but not limited to: <br /> <br />(a) "Public Access," which means access by users such as organizations, <br />groups, or individual members of the genera] public, on a <br />nondiscriminatory basis; <br /> <br />(b) "Educational Access," which means access by users such as schools and <br />educational institutions; <br /> <br />(c) "Government Access," which means access by users that are <br />governmental institutions or agencies; and <br /> <br />(d) "PEG Access," which means Public Access, Educationa] Access, and <br />Government Access, collectively. <br /> <br />"Affiliated Entitv" or "Affiliate" means any entity having ownership or control in <br />common with the Grantee, in whole or in part, including, without limitation, Grantee's parent <br />corporations and any subsidiaries or affiliates of those parent corporations. <br /> <br />"Basic Service" or "Basic Cable Service" or "Basic Service Tier" means the <br />lowest tier of cable service that includes the retransmission of local television broadcast signals, <br />including those of public, educational, and governmental access channels. <br /> <br />"]992 Cable Act" means the Cable Te]evision Consumer Protection and <br />Competition Act of ]992. <br /> <br />"Cab]e Act" means the 1984 Cable Act as amended by the] 992 Cable Act and by <br />the Telecommunications Act of] 996. <br /> <br />"Cable Operator" means any person or group of persons (i) who provides cable <br />service over a cable system; or (ii) who controls or is responsible for, through any arrangement, <br />the management and operation of a cable system. <br /> <br />"Cable Service" means the one-way transmission to subscribers of video <br />programming, or other programming services, and subscriber interaction, if any, that is required <br />for the selection or use of that video programming or other programming service. For the <br />purposes of this definition, "video programming" means programming provided by, or generally <br />considered comparable to programming provided by, a television broadcast station; and "other <br />programming service" means information that a cable system operator makes available to all <br />subscribers generally. <br /> <br />"Cable Svstem" or "Cable Television Svstem" or "Svstem" means a facility, <br />consisting of a set of closed transmission paths and associated signal generation, reception, and <br />control equipment that is designed to provide cable service that includes video programming and <br /> <br />] 2097-0002\680672v19.doc <br /> <br />-41- <br /> <br />Cit~, of Santa Ana <br />EXECUTION COPY 4/07/05 <br />
