Issue Notice of Decision to Appraise to property owners, attaching the City's Property Acquisition <br />Procedures Brochure. <br />4. If applicable, coordinate with Paragon's Relocation Assistance Agent regarding F&E list for any <br />affected businesses, based on the appraisal. <br />5. If required, prepare and make presentations to public groups, staff and elected officials, including, <br />business and neighborhood associations, and the City Council. <br />6. Obtain and review title reports and/or litigation guarantees including vesting deeds, supporting <br />documents and plotted easements. Coordinate clearance /elimination of clouds on title where <br />applicable. <br />7. Prepare all offer letters, summary statements, and lists of compensable items of F&E, in accordance <br />with state and federal regulations and approval of legal counsel. <br />8. Present the written offer to purchase to the appropriate owners or their representatives in person, <br />when possible, as soon as possible after receipt of signed offers from the City. In instances where the <br />property owner declines to acknowledge receipt of the offer to purchase, a certification of <br />presentation will be obtained and forwarded to the City. <br />9. Personally negotiate with the property owners (or their appointed representatives) for the purchase of <br />the required property rights. <br />10. Subject to concurrence of the property owner and prior to execution of the acquisition agreement, <br />coordinate contacts with Paragon's Relocation Assistance Agent, as may be required. <br />11. Continue personal negotiations with the property owners and tenants until every reasonable effort <br />has been expended and it appears that the only remaining method of acquisition is through eminent <br />domain proceedings. This process should take a maximum of 60-90 days. <br />12. Prepare all acquisition agreements and other documents necessary to complete the acquisition using <br />City approved forms. <br />13. If negotiations are not successful for acquisition of property interests, negotiate a Right of Entry to <br />start the Project. City staff will provide the Right of Entry form. <br />14. Promptly transmit all executed documents on successfully negotiated parcels to the City for <br />acceptance, including necessary supporting agenda items. <br />15. At such time that negotiations reach an impasse and eminent domain proceedings have commenced, <br />provide coordination and assistance necessary to aid the condemnation counsel. <br />16. In the course of negotiations with the property owners and tenants, provide all necessary information <br />to and work with Paragon's Relocation Assistance Agent if required, and City staff, in order to <br />expeditiously and professionally complete the Project. <br />17. Maintain a separate diary for each individual parcel and a diary of all pertinent information and <br />contacts concerning the Project parcels. <br />18. Provide a written report, in a form pre -approved by City staff, summarizing of the status of the <br />acquisition of each parcel on a monthly basis and/or upon request of City staff. <br />19. Coordinate the opening and closing of escrow; request funds from the City. <br />0 <br />
