City of Santa Ana Public Works Agency <br />Response to RFP for General Right of Way Services <br />Order and Review Prelinunary Title Reports (PTRs) and Litigation Guarantees <br />Paragon will order PTRs/or Litigation Guarantees for all parcels identified as required for a specific <br />assignment as directed by the City. All support documentation will be obtained to thoroughly review the <br />condition of title for each parcel, identify liens and encumbrances that must be cleared and develop a <br />plan to resolve and cure any title deficiencies identified. Paragon uses a "Title Review Check List" for <br />each parcel in order to document that each PTR was thoroughly reviewed. This document will be in each <br />file. We will use this data to prepare a comprehensive "Preliminary Title Review Report" that will <br />contain the compiled results of our review including the following: title vesting, title deficiencies, liens, <br />and encumbrances or other matters related to the condition of title. This could include the need for <br />probate documents, death certificates, unrecorded documents such as Trusts, Leases, Power of Attorney <br />agreements, re -conveyances, lien releases, etc. <br />Escrow Coordination Services <br />We will coordinate opening of all escrows, monitor same, assist the escrow company in obtaining <br />additional documentation as necessary, supervise and review the closing of all escrows and review all <br />closing statements for completeness and accuracy. Title insurance will be obtained for all properties and <br />permanent property rights acquired for each specific project assignments. We will assist the escrow <br />company in obtaining subordination agreements and any other title clearance documents necessary to <br />clear title for each property. Tax cancellation letters will be prepared for the City's signature, as <br />necessary, for fee interest acquisition as the recorded Grant Deeds are returned from Recorder's office. <br />When negotiations have reached an impasse and condemnation is necessary, the PTRs for each property <br />to be condemned will be upgraded to a Litigation Guarantee. <br />12 <br />
