<br />step level base salary of a Santa Ana Fire Captain is <br />two percent (2%) higher than the highest top step Fire <br />Captain in any other Orange County Fire Department, on <br />that date; or 2) that percentage increase in an <br />across-the-board salary adjustment provided to any <br />other City bargaining unit during fiscal year 2006-07. <br /> <br />C. Effective July 2, 2007, the base salary of employees <br />covered by this Agreement shall be increased by the <br />greater of the following amounts: 1) that percentage <br />increase necessary, rounded to the nearest half-percent <br />(.5%), not to exceed nine (9) salary rate ranges <br />(approximately 4.5%), to ensure that the top step level <br />base salary of a Santa Ana Fire Captain is two percent <br />(2%) higher than the highest top step Fire Captain in <br />any other Orange County Fire Department, on that date; <br />or 2) that percentage increase in an across-the-board <br />salary adjustment provided to any other City bargaining <br />unit during fiscal year 2007-08. <br /> <br />4.4 Application of Basic Compensation Plan. The salary rate <br />ranges and steps contained in Section 4.2 hereof are <br />monthly salary rates. All employees working in <br />classifications of employment covered by this Agreement <br />shall be compensated at a monthly rate, except that an <br />employee hired for temporary work in a position which has <br />an anticipated duration of less than six months shall be <br />paid at a rate per hour for actual time spent in the <br />performance of the duties of his or her employment. Any <br />hourly rate of pay, defined as the regular hourly rate of <br />pay, shall be computed in accordance with the applicable <br />provisions of the Fair Labor Standards Act (FLSA). In <br />determining the hourly rate as herein provided, <br />computation shall be made to the nearest whole cent, and a <br />computation resulting in exactly one-half cent shall fix <br />the rate at the next higher whole cent. <br /> <br />4.5 Beginning Rates. <br /> <br />A. Except as provided in Subsection A herein and in <br />Subsection B below, a newly hired sworn employee <br />represented by the Association and in a class <br />considered "Safety" under CalPERS shall be paid the <br />rate shown as Step "A" in the salary rate range <br />allocated to the class of employment for which he or <br />she has been hired. In special instances where such <br />new employee possesses unique and exceptional <br />education, training, and/or experience qualifications, <br />the Fire Chief may submit a written request and <br />justification to the City Manager for authorization to <br /> <br />11 <br />
