<br />10.2 <br /> <br />10.3 <br /> <br />10.4 <br /> <br />10.5 <br /> <br />Any holiday which falls on a Sunday will be observed on <br />the following Monday. Any holiday which falls on a <br />Saturday will be observed on the Friday preceding the <br />holiday. <br /> <br />Holidays Special Shift Personnel, Uniformed. "Safety- <br />member" personnel and civilian Paramedics assigned to the <br />24-hour shift schedule and Fire Services Dispatchers <br />assigned to the 12-hour shift schedule will receive nine, <br />12-hour working days off during the calendar year as paid <br />holidays in lieu of the holiday benefits specified in <br />Section 10.1, above. Said employees required to work on a <br />City observed "legal" holiday shall be paid at his or her <br />straight time rate. <br /> <br />Cash Option. All members covered by this Agreement shall <br />be given an option, twice per calendar year, concurrent <br />with the longevity vacation cash out option, to receive <br />cash compensation computed on a straight time basis in <br />lieu of all or part of their holiday leave benefits set <br />forth in Section 10.2 above. <br /> <br />Such option may be eliminated or modified at the <br />discretion of the Fire Department or to the extent it is <br />construed as overtime under Department of Labor guidelines <br />implementing provisions of the Fair Labor Standards Act <br />(FLSA) . <br /> <br />A newly-appointed employee must actually work at least one <br />day preceding the day a holiday listed in Section 10.1 <br />above actually occurs in order to receive credit for such <br />holiday during the month in which it occurs. <br /> <br />An employee separating from service of the City must <br />actually work at least one day following the day a holiday <br />listed in Section 10.1, supra, actually occurs in order to <br />receive compensation for the holiday. <br /> <br />A newly-appointed employee must complete six months of <br />continuous full-time service in order to receive credit <br />for the Floating Holiday listed in Section 10.1 above. <br /> <br />Holiday benefits may not be carried over from one calendar <br />year to the next. <br /> <br />49 <br />
