<br />o. A covenant establishing the City of Santa Ana's release of liability <br />regarding the unique parking facility (parking lift) shall be recorded <br />with the County of Orange Recorder's Office. <br /> <br />11. A tentative tract and final tract map shall be approved prior to the applicant <br />exercising the rights conferred by this conditional use permit. <br /> <br />12. This conditional use permit shall be null and void and of no force and <br />effect unless and until the City Council, in the exercise of its sole <br />discretion, approves a tentative tract map for this project. <br /> <br />13. The proposed structure shall be built to all applicable commercial codes <br />established by the 2001 California Building Code, and shall be compliant <br />with the Americans with Disabilities Act to allow for the commercial uses <br />on upper floors. <br /> <br />14. Prior to issuance of building permits, the exterior building amenities, <br />materials and finishes, and balcony railings shall be submitted for review <br />and approval by the Planning Division. Exterior glass shall be Class "A" <br />and blue or green non-reflective, safety material. <br /> <br />15. Prior to issuance of building permits, specifications and details of the rollup <br />window covers shall be provided to the Planning Division for review and <br />approval. <br /> <br />16. Prior to issuance of building permits, the exterior building amenities, <br />specifically the courtyard area at street level, water feature, street furniture <br />and seating, security fencing, as well as materials and finishes shall be <br />submitted for review and approval by the Planning Division. <br /> <br />17. The applicant shall provide a plan for lighting and landscape maintenance. <br />The lighting and landscape plan and design will be reviewed by the <br />Planning Division during the plan check phase. <br /> <br />18. Prior to issuance of building permits, the exterior building amenities, <br />specifically for the roof deck area, as well as materials and finishes, and <br />roof deck railings, and accessibility shall be submitted for review and <br />approval by the Planning Division.
