<br />, <br /> <br />'-' <br /> <br />,..." <br /> <br />VII. <br /> <br />PROPOSAL REJECTION <br /> <br />The city reserves the right to change the proposal and <br />schedule and to reject any or all proposals. If such <br />decision is made, the City shall not be liable for any pre- <br />contractual Expenses. <br /> <br />Pre-contractual expenses are defined as expenses incurred by <br />the proposer in: (a) preparing the proposal in response to <br />this RFP; (b) submitting that proposal to the City; (c) <br />negotiating with the City any matter related to this <br />proposal; and (d) any other expenses incurred by offer or <br />prior to date of award. <br /> <br />Proposer shall not include any such expenses as part of the <br />fee as proposed in response to this RFP. <br /> <br />VIII. ADDENDA <br /> <br />Any changes to the RFP shall be made in the form of an <br />addendum by the issuing office to those parties who have <br />received the RFPs. <br /> <br />IX. PROPOSAL CONTENT AND SIGNATURE <br /> <br />The proposer shall submit eight copies of the proposal. All <br />copies shall be signed by the individual or, if a company, <br />the company official with the power to bind the company in <br />its proposal. To be considered, all proposals must be <br />completely responsive to the RFP. <br /> <br />X. ACCEPTANCE OF CONTRACT <br /> <br />The contents of the proposal of the successful proposer <br />shall become contractual obligations if a contract ensues. <br />Failure of the consulting firm to accept the obligations <br />will result in cancellation of the award, and the resulting <br />damage accrued by the City may be recovered from the <br />consulting firm. <br /> <br />A copy of the City's standard consulting agreement is <br />included in Appendix B for the proposer's information. <br /> <br />XI. DISCLOSURE <br /> <br />If there is any information that the proposer does not wish <br />to disclose, other than for the purpose of evaluation, the <br />proposer should have each applicable sheet or part marked <br />"Confidential". This data shall not be disclosed or <br />duplicated, used or disclosed in whole or in part for any <br />purpose other than to evaluate the response. However, in <br /> <br />" <br />
