MBA will also be responsible for the preparation of the following sections of the EIR: - Table of Contents - Irreversible and Irretrievable Commitment of Resources - List of Organizations and Persons Consulted List of Preparers of the EIR - References Appendices Task 2.4: Draft EIR The contents will be consistent with all applicable provisions of the California Environmental Quality Act (1970) and shall include the text of the Screencheck Draft EIR with revisions directed by the City's project manager and environmental administrator. To facilitate this process, the following steps will be taken: ■ Coordinate with the City project manager who will assemble comments on, and suggested revisions to, the Screencheck Draft EIR. One set of unified City staff comments will be provided to MBA. The City will reconcile conflicting review comments, if necessary. ■ Complete one set of revisions to the Screencheck Draft EIR, pursuant to review comments. Revisions will be prepared in conformance with the scope of work. ■ Prepare one `proof check' copy of the Draft EIR for City review prior to distribution of the Public Review Draft EIR. ■ Produce 20 hard copies and one CD-ROM of the Public Review Draft EIR in .pdf format, and four hard copies plus one CD-ROM of the Technical Appendices. MBA will prepare the notice of completion (NOC) and submit it to the State Clearinghouse with the required copies of the Public Review Draft EIR. Using the City's approved list, MBA will distribute the remaining copies of the Public Review Draft EIR by mail. Task 2.5: Draft Final EIR The contents will be consistent with all applicable provisions of the California Environmental Quality Act (1970) and will include: ■ The text of the Public Review Draft EIR ■ Comments & Responses to Comments: A copy of all written comments received on the Public Review Draft EIR during the mandated public review process, and appropriate responses to comments consistent with the requirements of CEQA. Draft Responses to Comments (RTC) will be prepared in consultation with City staff. MBA will finalize the RTC for distribution to agencies, organizations and individuals, and City departments that provided comments on the Draft EIR (at least ten days in advance of the hearing to consider certification of the EIR and approval of the project). ■ Findings of Fact —Prepared for each significant effect identified in the EIR, pursuant to Section 15091 of the State CEQA Guidelines (Section 21081 of CEQA) ■ Statement of Overriding Considerations (if applicable) —Prepared pursuant to Section 15093 of the State CEQA Guidelines ■ Mitigation Monitoring and Reporting Program (MMRP)—Prepared to comply with Public Resources Code Section 21081.6, as mandated by Assembly Bill 3180 (Cortese 1988), for adoption at the time of the CEQA findings 10
