PERFORMANCE PERIOD A. The contract shall begin upon approval by the City Council, and the Consultant shall commence work after notification to proceed by the City. Unless extended by contract amendment, the contract shall terminate upon acceptance by the City of the project as constructed and upon completion by the Consultant and approval of the City of the as -built plans. B. The Consultant is advised that any recommendation for contract award is not binding on the City until the Agreement is fully executed and approved by the City Council. ESTABLISHING OF FEES Upon the approval of the PSR/PR and Environmental Document, the scope of work and associated fee estimate for the PS &E Preparation will be reevaluated. If it is determined that changes to the PS &E scope of work occurred as a result of the PSR/PR and Environmental Document phase, a revised scope and fee estimate will be negotiated and a contract change order issued, if necessary. CITY RESPONSIBILITY The City of Santa Ana will be responsible for the following: A. Providing all available existing City plans and records. Consultant is responsible for researching available records and paying for copies of records. B. Microstation symbol library. C. Pay for permit fees D. All right -of -way services, including preparation of legal descriptions, plats, appraisals, and acquisitions. EXAMINATION OF SITE PRIOR TO SUBMITTING PROPOSAL Each consultant must inform himself fully of the conditions relating to the project and the employment of labor thereon. Failure to do so will not relieve a successful consultant of the obligation to carry out the provisions of the contract. PRIME CONSULTANT RESPONSIBILITIES The selected consultant will be required to assume responsibilities for all services offered in his proposal. The selected consultant will be the sole point of contact with regard to contractual matters, including payment of any and all charges resulting from the contract. 18
