PERFORMANCE PERIOD <br />A. The contract shall begin upon approval by the City Council, and the Consultant <br />shall commence work after notification to proceed by the City. Unless extended <br />by contract amendment, the contract shall terminate upon acceptance by the <br />City of the project as constructed and upon completion by the Consultant and <br />approval of the City of the as -built plans. <br />B. The Consultant is advised that any recommendation for contract award is not <br />binding on the City until the Agreement is fully executed and approved by the <br />City Council. <br />ESTABLISHING OF FEES <br />Upon the approval of the PSR/PR and Environmental Document, the scope of work and <br />associated fee estimate for the PS &E Preparation will be reevaluated. If it is determined that <br />changes to the PS &E scope of work occurred as a result of the PSR/PR and Environmental <br />Document phase, a revised scope and fee estimate will be negotiated and a contract change <br />order issued, if necessary. <br />CITY RESPONSIBILITY <br />The City of Santa Ana will be responsible for the following: <br />A. Providing all available existing City plans and records. Consultant is responsible <br />for researching available records and paying for copies of records. <br />B. Microstation symbol library. <br />C. Pay for permit fees <br />D. All right -of -way services, including preparation of legal descriptions, plats, <br />appraisals, and acquisitions. <br />EXAMINATION OF SITE PRIOR TO SUBMITTING PROPOSAL <br />Each consultant must inform himself fully of the conditions relating to the project and <br />the employment of labor thereon. Failure to do so will not relieve a successful <br />consultant of the obligation to carry out the provisions of the contract. <br />PRIME CONSULTANT RESPONSIBILITIES <br />The selected consultant will be required to assume responsibilities for all services <br />offered in his proposal. The selected consultant will be the sole point of contact with <br />regard to contractual matters, including payment of any and all charges resulting <br />from the contract. <br />18 <br />
