WOO <br />T. Financial Interest. SU BRECI PI ENT agrees that except for the use of ESG funds <br />to pay salaries and other related administrative or personnel costs, no persons who exercise or have <br />exercised any function with respect to ESG activities assisted under the terms of this Agreement, or <br />who are i n a poli ti on to pati ci pate i n a deci si on-maki ng process or gai n i na de i riformati on with <br />regard to such ac iviti es, may obtain a financial interest or benefit from a ESG-assisted activity of <br />SUBRECIPI ENT, either for themselves or those with whom they have family or business ties, <br />during their tenure or for one year thereafter. This prohibition applies to any person who is an <br />employee~ agent, consul tact, offioer, or el acted or appoi nted offi ci al of Cl TY, or of <br />any designated publ is agencies, or the SU BRECI R ENT. <br />U. Davi s-Baoon Act. All laborers and mechanics employed by contractors or <br />subcontractors i n the performance of constructi on work, i nd udi ng al terati ons and repai rs, i n excess <br />of $2,000.00, financed in whole or in pat with federal funds shall be pad wages at rates not less <br />than those preva I i ng on si mi I ar corstructi on i n the I ocal i ty as determi ned i n accordance with the <br />Davis -Bacon Act, as amended, 40 U.&C. sections 276a - 276a-5. Any such construction contract <br />shall include and comply with the required contract provisions and rules set forth in 29 C.F.R. §5.5. <br />Further, the payroll reports (along with the "Statement of Compl i a>od') and basic records are <br />required to be mai nta ned and submitted, or made ava I abl e, pursuant to 29 C.F.R. §5.5(a)(3). No <br />payment, advance; grant, loan or guarantee of funds shall be approved by the federal agency uNess <br />there is on file with the agency a certification by the contractor that the contractor and its <br />subcontractors have oompl i ed wi th the provi si ons of 29 C. F. R. §5.5. A breach of the contract d a.ises <br />i n 29 C. F. R. §5.5 may be grounds for tern~ nati on of the contract, and for debarment as a <br />contractor/subcontractor, as provi ded i n 29 C. F. R. §5.12. L abor standards i ntervi a Nsli nvesti gati ons <br />shall be made as necessary to assure compliance [29 C.F.R. §5.6(a)(3)]. <br />V. Homeless Involvement. SU BRECI PI ENT certifies that it wi I I involve, to the <br />maximum extent practicable; homeless individuals and fermi 1 ies in constructing, renovating, <br />ma nta ni ng, and operati ng fad I i ti es asci sted under the ESG program, and i n provi di ng cervi ces for <br />occupants of these fad I ities [24 CFR 576.56(b); 42 USC 11 375(d)]. <br />W.
