<br />Agreement #W7 -GJC-10 <br />City of Santa Ana <br /> <br />1 (k) All insurance policies required by this Agreement shall waive all rights of subrogation against the <br />2 County of Orange and members of the Board of Supervisors, its elected and appointed officials, officers, <br /> <br />3 agents and employees when acting within the scope of their empioyment or appointment. <br /> <br />4 (I) The Commercial General Liability policy shall contain a severability of interests clause. <br /> <br />5 (m) CONTRACTOR is aware of the provisions of Section 3700 of the California Labor Code which <br /> <br />6 requires every employer to be insured against Iiabiiity for Workers' Compensation or be self-insured in <br /> <br />7 accordance with provisions of that code. CONTRACTOR will comply with such provisions and shall furnish <br /> <br />8 COUNTY satisfactory evidence that CONTRACTOR has secured, for the period of this Agreement, <br /> <br />9 statutory Workers' Compensation insurance and Empioyers' Liability insurance with minimum limits of <br /> <br />10 $1,000,000 per occurrence. <br /> <br />11 (n) If CONTRACTOR fails to provide the insurance certificates and endorsements within seven (7) <br /> <br />12 days of notification by CEO/Risk Management or by CONTRACT ADMINISTRATOR, award may be made <br /> <br />13 to the next qualified proponent. <br /> <br />14 (0) COUNTY expressly retains the right to require CONTRACTOR to increase or decrease <br /> <br />15 insurance of any of the above insurance types throughout the term of this Agreement. Any increase or <br /> <br />16 decrease in insurance will be as deemed by CEO/Risk Management as appropriate to adequately protect <br /> <br />17 COUNTY. <br /> <br />18 (p) COUNTY shali notify CONTRACTOR in writing of changes in the insurance requirements. if <br /> <br />19 CONTRACTOR does not deposit copies of acceptable certificates of insurance and endorsements with <br /> <br />20 CONTRACT ADMINISTRATOR incorporating such changes within thirty (30) days of receipt of such <br /> <br />21 notice, this Agreement may be in breach without further notice to CONTRACTOR, and COUNTY shall be <br /> <br />22 entitled to all legal remedies. <br /> <br />23 (q) The procuring of such required policy or policies of insurance shall not be construed to limit <br /> <br />24 CONTRACTOR's liability hereunder or to fulfill the indemnification provisions and requirements of this <br /> <br />25 Agreement. <br /> <br />26 <br /> <br />WIA Cost Reimbursement Agreement - Green Jobs Corps <br /> <br />27 <br />
