4 NO ENVIRONMENTAL EFFECTS AND LESS THAN SIGNIFICANT <br />ENVIRONMENTAL EFFECTS WITHOUT MITIGATION MEASURES <br />Additionally, the City finds that the Project will implement regulatory requirements RR HAZ-1, RR <br />HAZ-2; RR HAZ-4 through RR HAZ-6 (listed above). (Draft Supplemental EIR, <br />pp. 4.6-21 — 4.6-22.) <br />Explanation of the Rationale: The Project site is not included on any hazardous waste site lists <br />included in the Department of Toxic Substances Control's EnviroStor database, which includes <br />CORTESE sites and the Environmental Protection Agency's database of regulated facilities, or <br />other lists compiled pursuant to Section 65962.5 of the Government Code. No impacts would <br />occur. (Draft Supplemental EIR, pp. 4.6-21 — 4.6-22.) <br />Threshold H-5: The Project would not result in a safety hazard or excessive noise for <br />people residing or working in the project area within two miles of a public <br />airport or public use airport. <br />Findings: The City finds that the Project would result in no impacts to hazards and hazardous <br />materials related to airports. (Draft Supplemental EIR, pp. 4.6-22 — 4.6-23.) <br />Additionally, the City finds that the Project will implement regulatory requirements RR HAZ-1, RR <br />HAZ-2; RR HAZ-4 through RR HAZ-7 (listed above) and the following regulatory requirement <br />(Draft Supplemental EIR, p. 4.6-9): <br />RR HAZ-7: Development will be designed and constructed in accordance with the airport <br />environs land use plan for John Wayne Airport. Building height restrictions, as specified in <br />the airport environs land use plan, would apply in the city. <br />Explanation of the Rationale: The Project site is located approximately 1.5 miles northwest of <br />Santa Ana Airport (SNA) and outside any SNA Safety Compatibility Zones (including the Runway <br />Protection Zones) and the 60 dbA CNEL noise contours. Therefore, the Project would not result <br />in a safety hazard or excessive noise for people residing or working in the Project area. Further, <br />the Project site is located within the Airport Environs Land Use Plan Notification Area for SNA, <br />which includes the Federal Aviation Regulations Part 77 Notification Area. The Project is required <br />to be submitted to the Federal Aviation Agency (FAA) and the Orange County Airport Land Use <br />Commission for aeronautical review. Upon completion of the review process, the project would <br />not result in a safety hazard or excessive noise for people residing or working in the Project area. <br />No impact would occur. (Draft Supplemental EIR, pp. 4.6-22 — 4.6-23.) <br />Threshold H-6: The Project would not impair implementation of or physically interfere with <br />an adopted emergency response plan or emergency evacuation plan. <br />Findings: The City finds that the Project would result in less than significant impacts to hazards <br />and hazardous materials related to an adopted emergency response plan or emergency <br />evacuation plan. Additionally, the City finds that the Project will implement regulatory <br />requirements RR HAZ-1, RR HAZ-2; RR HAZ-4 through RR HAZ-7 (listed above).
