CUP No. 2025-17 – Unsung Brewing Company (2590 S. Redhill Avenue, Unit C) <br />September 22, 2025 <br />Page 3 <br />5 <br />2 <br />8 <br />6 <br />Project Background <br />On February 2, 2016, the City Council approved General Plan Amendment No. 2015-03, <br />Amendment Application No. 14-04, and Ordinance No. NS-2892, which approved the <br />change in General Plan land use designation from Industrial (IND) to District Center (DC) <br />and the rezoning of the project site from Light Industrial (M-1) to SD-88 in order to facilitate <br />the development of The Heritage, a mixed-use development project (now known as <br />Broadstone) that was completed in 2020. <br />The development consists of three mixed-use buildings containing a total of 1,221 <br />apartment units, 12,675 square feet of retail and commercial space, and 5,415 square <br />feet of restaurant space on 18.84 acres. The subject tenant space is located on the first <br />floor of the Broadstone Atlas mixed-use building. On July 31, 2025, the applicant <br />submitted the subject CUP application to the Planning Division. Since the application was <br />submitted, staff has been working with the applicant, ABC, Code Enforcement, and the <br />Police Department to address any potential adverse impacts associated with the sale of <br />alcoholic beverages for off-premises consumption at the subject location. <br />This will be the business’ second location, with the first located in the Anaheim Packing <br />District in Anaheim. The new location will follow a similar business model to the Anaheim <br />site, which features superhero décor, comic books, Lego displays, and specialty artwork. <br />The business’ beverages incorporate original artwork that pays homage to the superhero <br />theme, and the interior walls of the new location will be similarly decorated to reflect the <br />style of the Anaheim location. The business also serves a variety of craft beers, lagers, <br />Hazy IPAs, seltzers, etc. While specialty beers will be sold on-site, manufacturing and <br />production will occur at the business’ off-site facility in the City of Tustin. <br />Project Analysis <br />CUP requests are governed by Section 41-638 of the SAMC, and may be granted by the <br />Planning Commission when it can be demonstrated that the proposed project will not <br />adversely impact the community. If these findings can be made, then it is appropriate to <br />grant the CUP. Conversely, the inability to make these findings would result in a denial. <br />The purpose of regulating establishments that sell alcoholic beverages is to set forth <br />operating practices and procedures and to minimize impacts to surrounding areas. Staff <br />has reviewed the Applicant’s request and has determined that the proposed CUP will not <br />be detrimental to the health, safety, and welfare of the community. Based on staff’s review <br />and analysis, approval of CUP No. 2025-17 is recommended. <br />The proposed sale of alcoholic beverages for on-premises consumption at the proposed <br />location will provide an ancillary service to the establishment’s customers by allowing <br />them the ability to purchase a variety of specialty beers in conjunction with food. This <br />would allow Unsung Brewing Company to remain economically viable and compete with <br />nearby eating establishments offering the same type of service. The operational <br />standards applicable to an ABC license, per Section 41-196(g) of the SAMC, will mitigate <br />
