2. Will not support the employee's request. <br /> a. If the Department Head does not support the employee's request for a <br /> classification review, they shall notify the employee of this decision in <br /> writing and set forth the basis for the decision. <br /> b. If the Department Head does not support the employee's request, but agrees <br /> that some of the duties and/or responsibilities being performed by the <br /> employee are those of a different City classification,they shall: <br /> • Eliminate the duties and/or responsibilities of the different City <br /> classification being performed by the employee, and <br /> • Return the employee to performance of the duties and/or <br /> responsibilities of their proper classification. <br /> C. Any employee request for classification review approved by the Department Head <br /> will be forwarded to the Executive Director of Human Resources or designee. The <br /> Executive Director of Human Resources or designee shall confirm receipt of the <br /> request in writing to the employee.Within sixty(60)calendar days of receipt of the <br /> request, the Executive Director of Human Resources or designee will notify the <br /> employee and Department Head of the decision as to whether a study will be <br /> conducted. If the Executive Director of Human Resources or designee determines <br /> that a study is appropriate,the Executive Director of Human Resources or designee <br /> will so notify the employee and the Department Head in writing and will provide <br /> the employee and Department Head with an approximate start date for the study. <br /> D. Determinations of the Department Head and the Executive Director of Human <br /> Resources are not final.An appeal to the City Manager or their representative shall <br /> be presented within fifteen (15)working days of the notification of the findings by <br /> the Executive Director of Human Resources. The City Manager's decision is final. <br /> This process is not subject to the grievance provisions of this MOU. <br /> E. All studies and study findings will require City Manager or designee approval <br /> before proceeding. <br /> F.
