2. A subpoenaed employee scheduled to appear in court (including but not <br /> limited to depositions, meetings, and interviews) on City business during off.- <br /> duty time may be placed in a standby status by the Department Head or their <br /> authorized representative if the employee can respond to the court, if called, <br /> within sixty(60) minutes of the employee's notification. <br /> In the event such off-duty employee is on standby status during any court <br /> session and is not required to appear in court, such employee shall be <br /> compensated two(2)hours on a straight time basis,for each said court session. <br /> With the approval of the Department Head, the employee may elect, in lieu of <br /> paid time,to take two(2) hours of compensatory time off for the standby time <br /> and not appearing in court. <br /> If such off-duty employee on standby actually appears in court, they shall be <br /> compensated as provided in Section 10.11(A)(1). <br /> B. Jury Duty or Witness <br /> 1. When an on-duty employee is called to serve as a juror or non-party witness <br /> in.any court action,they shall be allowed to leave for the time actually required <br /> for such service without loss of pay. <br /> Each on-duty employee called for such service shall present their Department <br /> Head the jury summons or subpoena calling them to such service and shall pay <br /> into the City Treasury the fees collected for such service, excluding any <br /> reimbursement for mileage expenses. <br /> An employee on jury duty who is released from jury duty by the court may <br /> take off for the rest of their workday if taking into consideration the time it <br /> would take to travel back to work, there would still be two (2) hours or less <br /> left on their shift. If there would be more than two (2) hours left in their shift <br /> at the time they would arrive at work,the employee must return to work or call <br /> in to their supervisor and ask to use leave to cover the rest of their shift. <br /> 2. If an employee is called to serve on jury duty during a normal day off or on a <br /> City holiday, then the jury duty shall be considered the same as having <br /> occurred during the employee's regular day off work; therefore,the employee <br /> will receive no added compensation. <br /> 2025 MOU City of Santa Ana&SEIU Full-Time Employees Unit Page 58 <br />
