1 124. On November 9, 2021, MENENDEZ returned to work after a vacation. <br /> 2 <br /> 125. On his first day back,Sergeant Shin walked into the roll call room,interrupted a private team <br /> 3 <br /> 4 meeting between MENENDEZ, his teammates and his supervisors and told MENENDEZ that he <br /> 5 immediately"needed to see [MENENDEZ] outside in the hallway." <br /> 6 126. When the two men went out to the hallway, Sergeant Shin was visibly upset and attempted <br /> 7 <br /> to argue with MENENDEZ about various POA issues in which MENENDEZ held opinions contraryto those <br /> 8 <br /> 9 of the Valentin"camp/gang.". <br /> 10 127. That same day (November 9, 2021), MENENDEZ filed a hostile work environment <br /> 11 complaint via his chain of command. <br /> 12 <br /> 128. As of the filing of this Complaint, MENENDEZ has not been contacted by anyone at CITY <br /> 13 <br /> 14 regarding this complaint. <br /> 15 V. The 2021 Request for Change of Assignment Promotional. <br /> 16 129. In or about November of 2021, MENENDEZ participated in the "request for change of <br /> 17 <br /> assignment'for the Field Training Officer("FTO") position, a prerequisite for applying for the position of <br /> 18 <br /> 19 Corporal. <br /> 20 130. Shortly thereafter, MENENDEZ was informed that he was No. 1 on the List. <br /> 21 131. However,on April 22, 2022, MENENDEZ learned that certain persons had been promoted <br /> 22 <br /> ahead of him and that MENENDEZ remained on a six-month eligibility list. <br /> 23 <br /> 24 132. Thereafter,on or about November 16,2022,MENENDEZ received an email informing him <br /> 25 that the City was"currently accepting Request for Change of Assignment for the position of Field Training <br /> 26 Officer." <br /> 27 <br /> 133. In other words, CITY had purposefully allowed the List- on which MENENDEZ was the <br /> 28 <br /> No. 1 candidate- to expire and was now conducting another promotional exam. <br /> 21 <br /> MENENDEZ V.
