12. Adopt a resolution approving Variance No. 2005-05 as conditioned to <br />allow a reduction in setbacks for the Lake Towers project. <br />13. Adopt a resolution approving Variance No. 2005-07 as conditioned for a <br />reduction in parking and tandem parking for the Lake Towers project. <br />14. Adopt a resolution approving Variance No. 2005-10 as conditioned for a <br />reduction in parking for the Cinema residential, retail and restaurant uses <br />and to allow tandem parking. <br />15. Adopt a resolution approving Variance No. 2005-12 as conditioned to <br />allow tandem parking for the Integral condominium project. <br />Senior Planner Vince Fregoso recapped the Nexus project's various entitlements. Mr. <br />Fregoso presented the Commission with additional MacArthur Place South documents <br />that were omitted from the Planning Commission packets. The first document was the <br />Vesting Tentative Tract Map for the Integral development to be located at 1 East Hutton <br />Centre Drive. The second document was the proposed Specific Development Plan <br />(SD-76) for MacArthur Place South, more commonly known as Hutton Centre. <br />Environmental Coordinator Dan Bott gave an overview of the certification of the Final <br />Environmental Impact Report (EIR). <br />Chief Assistant City Attorney Kaufman recommended the inclusion of fence ordinance <br />exception for Specific Development No.19. <br />Chair Mondo noted that the development agreement was not signed and requested <br />clarification on pending issues. Chief Assistant City Attorney Kaufman provided <br />information for Commission. <br />Public Hearing was open. <br />Applicant Corey Alder discussed the Phasing Plan as set forth in Exhibit F, suggested <br />flexibility for financing and agreed that Cinema Towers would be built before or <br />Planning Manager Trevino emphasized Nexus would incur costs for public art, <br />contribute in-lieu park development fee, pay Inclusionary Housing Fee, provide <br />covenants, conditions, and restrictions, and execute an avigation easement and <br />cooperative agreement for off-site improvements. Mr. Trevino noted that pending <br />issues involved phasing and policy matters. <br />concurrent with the Lake Towers. <br />Commissioner Nalle requested an explanation regarding outstanding issues in the <br />Development Agreement. Discussion ensued that Phasing completion was predicated <br />on market conditions and available financing. Applicant proposed 10-year development <br />with Towers, agreed not to start Integral unless the Lake or Cinema goes concurrently. <br />Mr. Alder stated there are legal issues pending that require more time to allow meeting <br />construction timelines. Mr. Alder stated that commitment from lenders would be <br />forthcoming by the fourth quarter 2005. <br />Commissioner Leo commented on market rate units, retail tenants, neighborhood traffic <br />and construction and costs for study inclusive of mitigation measures. City Engineer <br />Alvarez reviewed costs for study. Commissioner inquired about Airport Land Use <br />Commission's (ALUC) update. Mr. Alder indicated the project is scheduled for ALUC's <br />review and approval on June 16. <br />Commissioner Leo discussed on-off ramp provisions on the 55 freeway backup plan if <br />OCTA/Cal Trans/Alton setbacks exist. City Engineer Alvarez reviewed the accelerated <br />ramp improvements with OCTA that are scheduled for July 2005, also stated OCTA and <br />Nexus would provide funding. Mr. Alvarez stated that Alton is a long-term project that <br />would be pursuing state and federal funding (Measure M) due to the high costs.
