SUPPLANTING GOVERNMENT FUNDS <br /> <br /> 2 CONTRACTOR shall not supplant any Federal, State or COUNTY funds <br /> 3 intended for the purposes of this Agreement with any funds made available <br /> <br /> 4 under this Agreement. CONTRACTOR shall not claim reimbursement from COUNTY <br /> 5 for, or apply sums received from COUNTY with respect to, that portion of its <br /> <br /> 6 obligations which have been paid by another source of revenue. CONTRACTOR <br /> 7 agrees that it shall not use funds received pursuant to this Agreement, either <br /> <br /> 8 directly or indirectly, as a contribution or compensation for purposes of <br /> 9 obtaining Federal, State or COUNTY funds under any Federal, State or COUNTY <br /> <br /> 10 program without prior written approval of ADMINISTRATOR. <br /> 11 17. EQUIPMENT <br /> <br /> 12 17.1 All items purchased with funds provided under this Agreement or <br /> <br /> 13 which are furnished to CONTRACTOR by COUNTY which have a single unit cost of <br /> 14 at least five thousand dollars ($5,000.00), including sales tax, shall be <br /> I <br /> 15 considered Capital Equipment. Title to all items of Capital Equipment <br /> 16 purchased vests and will remain in COUNTY as such shall be designated by <br /> <br /> 17 ADMINISTRATOR. The use of such items of Capital Equipment is limited to the <br /> 18 performance of this Agreement. Upon the termination of this Agreement, <br /> <br /> 19 CONTRACTOR shall immediately return any items of Capital Equipment to COUNTY <br /> 20 or its representatives, or dispose of them in accordance with the directions <br /> <br /> 21 of ADMINISTRATOR. <br /> 22 CONTRACTOR further agrees to the following: <br /> <br /> 23 17.1.1 To maintain all items of Capital Equipment in good working <br /> 24 order and condition, normal wear and tear excepted. <br /> <br /> 25 17.1.2 To label all items of Capital Equipment, do periodic <br /> 26 inventories as required by ADMINISTRATOR and to maintain an inventory list <br /> <br /> 27 showing where and how the Capital Equipment is being used, in accordance with <br /> 28 procedures developed by ADMINISTRATOR. All such lists shall be submitted to <br /> <br /> <br /> (WAM0811) 20 of 40 (December 22, 2011) <br /> <br /> 20B-22 <br />
