VII. ADDENDA <br />Any subsequent changes to the RFP from the date of issuance to the date of <br />submittal will result in an addendum by the issuing office to those parties who <br />have provided the proper notice of interest in responding to the RFP. <br />VIII. PROPOSAL CONTENT AND SIGNATURE <br />Eight (8) copies of the proposal will be required with all copies having been <br />signed by the individual or, if a company, the company official with the power to <br />bind the company in its proposal. To be considered, all proposals shall be <br />completely responsive to the RFP. <br />IX. COST AND PRICE <br />The offeror shall furnish a fee schedule for the proposed service. The offeror <br />shall also complete Attachment "A" (Cost Comparison Form) located at the end <br />of the Request for Proposal and include it with the fee schedule. <br />The fee schedule (3 copies) and Attachment "A" shall be contained in a sealed <br />envelope apart from the proposal, and submitted to the City. The fee schedule <br />shall include the following: <br />A. Hourly rate for each personnel category. <br />B. Any other direct charges, if not included in the hourly rate. <br />Total annual cost for the contract shall not exceed $240,000. Funds not spent in <br />the year of allocation will be accumulated <br />X. ACCEPTANCE OF CONTRACT <br />The contents of the proposal of the successful consultant shall become a <br />contractual obligation if a contract ensues. Failure of a Consultant to accept this <br />obligation will result in the cancellation of any award. Any damage accruing to <br />the City as a result of a failure to contract may be recovered from the consultant. <br />A sample agreement is attached for reference. <br />XI. DISCLOSURE <br />Any information, other than cost and price, which a consultant does not wish to <br />have disclosed, other than for the purpose of evaluation, should have each <br />applicable sheet or part marked "Confidential' — this data shall not be disclosed <br />or duplicated, used or disclosed in whole or in part for any purpose other than to <br />evaluate the response; provided that: the contract is awarded to this offeror, or <br />as a result of or in connection with the submission of such information, the City <br />shall have the right to duplicate, use or disclose this information to the extent <br />provided in this contract. This restriction will not limit the City the right to use <br />information contained herein if it is obtained from another source. <br />5 <br />
