C City of Santa Ana <br />4.3.10 Disciplinary Actions for Failure to Meet Response Time Requirements/ Performance <br />Deficiency <br />A. Meet and Confer <br />Should a Contractor fail to meet the response time requirements set forth in this section in <br />any quarterly period, either for any single Code category or for the cumulative total of <br />Code 2 and Code 3 calls as outlined in section 4.3.3 -Response Times Required of this <br />RFP, the OCFA representative shall notify the Contractor and meet and confer with said <br />Contractor regarding performance and response time deficiencies. The purpose of this <br />meeting is to notify the Contractor of its deficiencies and to work with the Contractor to <br />ensure proper response time performance in the immediate future. <br />B. Penalties <br />At the discretion of the OCFA, monetary penalties may be assessed against a non- <br />compliant Contractor for failure to meet the response time requirements set forth in this <br />Section. Quarterly aggregate response times (i.e., in any quarterly period for any single <br />Code category) that are not in compliance with the response time requirements set forth <br />in this Section may result in the OCFA assessing the non-compliant Contractor with a <br />monetary penalty according to the following compliance and fine schedule: <br />Quarterly Responses That Are In <br />Compliance with Response Time <br />Requirements: Penalty Imposed*: <br />90% or Better None <br />85%-89.9% $5,000 <br />80%-84.9% $7,000 <br />Less than 79.9% $10,000 <br />*Note: Penalties are for Code 21Code 3 reported separately and calculated separately. <br />In addition to the above response time penalties, the OCFA may assess monetary penalties <br />against Contractor for the following: <br />i.
