Notwithstanding anything to the contrary, upon termination of this <br />Agreement, CONTRACTOR shall relinquish control with respect to participant <br />records to COUNTY in accordance with Subparagraph 44.2. <br />27.2.3 COUNTY may refuse payment for a claim if participant <br />records are determined by COUNTY to be incomplete or inaccurate. In the event <br />participant records are determined to be incomplete or inaccurate after <br />payment has been made, COUNTY may treat such payment as an overpayment within <br />the provisions of this Agreement. <br />27.3 Public Records: <br />With the exception of participant records or other records <br />referenced in Paragraph 32, entitled Confidentiality, all records, including <br />but not limited to, reports, audits, notices, claims, statements and <br />correspondence, required by this Agreement may be subject to public <br />disclosure. COUNTY will not be liable for any such disclosure. <br />27.4 Inspections and Audits: <br />27.4. The U.S. Department of Health and Human Services, <br />Comptroller General of the United States, Director of COSS, State Auditor- <br />General, ADMINISTRATOR, COUNTY's Auditor-Controller and Internal Audit <br />Department, or any of their authorized representatives, shall have access to <br />any books, documents, papers and records, including medical records, of <br />CONTRACTOR which any of them may determine to be pertinent to this Agreement <br />for the purpose of financial monitoring. Further, all the above mentioned <br />persons have the right at all reasonable times to inspect or otherwise <br />evaluate the work performed or being performed under this Agreement and the <br />premises in which it is being performed. <br />27.4.2 CONTRACTOR shall make available its books and financial <br />(WAM0313) <br />28 of 40 <br />(April 8. 2013)
