SAPD Integrated Law Enforcement Solution RFP <br />Chapter 1: Rules of Preparation <br />Current Version - "Packaged" application and system software shall be the most <br />current published or vendor's version in use, as of date of system delivery. <br />Changes - No alteration in any of the terms, conditions, delivery, price, quality, or <br />specifications of items ordered will be effective without the written consent of the <br />Police Department. <br />• Penalties - The Police Department may wish to include in the final contract penalty <br />provisions for non - performance such as liquidated damages. <br />Unavailability of Funds - If funds are not available to the Police Department, this <br />award will be postponed, canceled or phased. The Police Department makes no <br />guarantee by release of this RFP that any offerings will be selected and/or funded. <br />• Background Checks - The successful vendor will be required to authorize the <br />investigation of its personnel proposed to have access to non - public areas of the Police <br />Department facilities. The scope of the background check is at the discretion of the <br />Police Department. Proposed staff will be required to provide their full legal name, date <br />of birth and social security number. <br />Notice to Proceed— Will be issued after the Police Department receives the fully <br />executed contract. <br />Protest Process <br />Any protest must be submitted in writing to the Chief of Police, Santa Ana Police Department, <br />City of Santa Ana, 60 Civic Center Plaza, Santa Ana, CA 92702 before 5:00 p.m. of the 5th <br />business day following City's notification of intent to award contract. Protester is responsible <br />for ensuring timely delivery of protest. Hand delivered protests must be delivered to the front <br />desk of the Police Department. The protest shall include a complete statement of the basis for <br />the protest, and shall specify the basis for the protest. The protest shall include the name, <br />address and telephone number of the person representing the protesting party. The person filing <br />the protest shall concurrently transmit a copy of the protest document, and any attached <br />documentation to all other parties with a direct financial interest which may be adversely <br />affected by the outcome of the protest. Such parties include all other proposers who appear to <br />have a reasonable prospect of receiving an award depending on the outcome of the protest. The <br />burden of proof will be on the protesting party to demonstrate that staff's determination of the <br />proposed "best quality responsive service at minimum cost" is arbitrary and capricious or <br />"unsupported by substantial evidence in the record." <br />19C -17 1 <br />
