a written consent agreement is already in place from previous fiscal years, FEMA will <br />continue to recognize it for FY 2011. If any modifications to the existing agreement are <br />necessary to reflect new initiatives, States should contact their assigned FEMA Program <br />Analyst. <br />The SAA must obligate 100 percent (100 %) of the funds awarded under OPSG to local <br />units of government within 45 days of receipt of the funds. There are no obligation <br />requirements for MRS or CCP. However, if funds are retained, the maximum amount <br />that can be retained is equivalent to the percentage that the State can retain for M &A. <br />If funds are retained for CCP, consultation with local Citizen Corps Councils is required <br />to ensure funds are expended in a manner that supports local or statewide efforts to <br />educate, train, and involve citizens. Jurisdictions are encouraged to leverage available <br />funding resources to support community preparedness and participation. <br />A. Funding Guidelines <br />DHS grant funds may only be used for the purpose set forth in the grant, and must be <br />consistent with the statutory authority for the award. Grant funds may not be used for <br />matching funds for other Federal grants /cooperative agreements, lobbying, or <br />intervention in Federal regulatory or adjudicatory proceedings. In addition, Federal <br />funds may not be used to sue the Federal government or any other government entity. <br />Pre -award costs are allowable only with the written consent of DHS and if they are <br />included in the award agreement. <br />Federal employees are prohibited from serving in any capacity (paid or unpaid) on any <br />proposal submitted under this program. Federal employees may not receive funds <br />under this award. <br />Use of SHSP and LAS] funds must be consistent with and supportive of implementation <br />of the State Homeland Security Strategy. Linkages between specific projects <br />undertaken with SHSP and UASI funds and strategic goals and objectives will be <br />highlighted through regular required reporting mechanisms, including the BSIR. <br />The applicable SAAs will be responsible for administration of the FY 2011 HSGP. Ir <br />administering the program, the SAA must work with the eligible applicants to comply <br />with the following general requirements: <br />HSGP Priorities Threshold. As noted before, FY 2011 HSGP applies to all <br />capabilities with an emphasis on the eight National Priorities. <br />Law Enforcement Terrorism Prevention. Per the 9/11 Act, States are required to <br />ensure that at least 25 percent (25 %) of SHSP appropriated funds and 25 <br />percent (25 %) of UASI appropriated funds are dedicated towards LETPA. This <br />requirement does not include award funds from OPSG, MMRS, and CCP. <br />32 <br />
