B. Required Maintenance: DISTRICT hereby agrees to maintain <br />the exterior of all facilities, all ground and landscaped areas <br />in the portion of Centennial Park defined in the map identified <br />as "Exhibit D," in good order, condition and repair, to the satis- <br />faction of CITY'S Director of Recreation and Parks. DISTRICT <br />shall provide adequate waste receptacles on the said real property <br />and shall keep it free of litter, trash, paper, bottles and other <br />debris or rubbish occurring from the exercise of the license <br />herein granted. DISTRICT further covenants and agrees to main- <br />tain and be responsible for all landscaping, sidewalks, irriga- <br />tion systems, control of broken windows, lighting (except parking <br />lot lighting), refuse collection and any and all other mainte- <br />nance activities on the said real property. <br />C. Restriction on Uses: DISTRICT hereby agrees that it shall <br />exercise all rights and undertake all activities pursuant to this <br />Agreement in conformance with the covenants, conditions and restric- <br />tions placed on CITY by the deeds, Exhibits "B" and "C" hereto, <br />as those are defined by the U.S. Department of the Interior, <br />Heritage Conservation and Recreation Service, Pacific Southwest <br />Regional Office, or its successors, including but not limited to <br />the following conditions: <br />(1) DISTRICT'S facilities and programs are to be primarily <br />leisure and recreation oriented. <br />(2) DISTRICT'S facilities are to be open to the general <br />public. <br />(3) Ultimate control and responsibility for development, <br />operation and maintenance of said real property and <br />DISTRICT'S facilities shall remain with the CITY and <br />COUNTY, subject to the review and concurrence of the <br />U.S. Department of the Interior, Heritage Conservation <br />and Recreation Service, Pacific Southwest Regional. <br />k, <br />
