Code of Civil Procedure, City representatives may enter and <br />inspect the Property of every Medical Marijuana Collective between the hours of <br />10:00 A.M. and 10:00 P.M., to ensure compliance and enforcement of the <br />provisions of this Chapter. <br />A. The inspection and copying of private medical records shall be made <br />available to the Police Department only pursuant to a properly executed search <br />warrant, subpoena, or court order and only when such use and disclosure by the <br />City, including but not limited to the police department, is in full compliance with <br />the Privacy and Security provisions of the Health Insurance Portability and <br />Accountability Act of 1996, as codified at 42 U.S.C. § 1320d, and as amended in <br />2009 by the Health Information Technology for Clinical and Economic Health Act <br />( "HITECH "), as codified at 42 U.S.C. § 17901, et seq. (specifically subtitle D of <br />the American Recovery and Reinvestment Act of 2009, the "ARRA" ), and under <br />the regulations promulgated by the Secretary of Health and Human Services <br />found in 45 C.F.R. §§ 160 -164 and updated from time to time. <br />B. It is unlawful for any Property owner, landlord, lessee, Medical <br />Marijuana Collective member or Management Member or any other person <br />having any responsibility over the operation of the Medical Marijuana Collective <br />Ito refuse to allow, impede, obstruct or interfere with an inspection. <br />19 <br />04202014 -RE V30 <br />
