No information or records maintained by the City as a result of an <br />inspection conducted pursuant to this Section or otherwise provided by a Medical <br />Marijuana Collective, Managing Members, or members to the City under this <br />Chapter or as a result of any investigation shall be provided to the federal <br />government unless a court of competent jurisdiction issues an order requiring <br />such disclosure. The City shall, at all times, give meaning and effect to California <br />law and shall not enforce federal law related to marijuana. <br />080 Existing Medical Marijuana operations. <br />A. Any existing Medical Marijuana Collective, dispensary, operator, <br />establishment, or provider that does not comply with the requirements of this <br />Chapter must immediately cease operation until such time, if any, when it <br />complies fully with the requirements of this Chapter. Except as provided for in <br />Subsection B of this Section, no Medical Marijuana Collective, dispensary, <br />operator, establishment, or provider that existed prior to the enactment of this <br />Chapter shall be deemed to be a legally established use or a legal non- <br />conforming use under the provisions of this Chapter or the Code. <br />B. Any Medical Marijuana Collective established and operating within the <br />City and in full conformance with State Law, whether such operation was with or <br />without a Business License or Occupancy Permit, prior to December 31, 2011, <br />that the establishment and operation thereof would be subject to this Chapter <br />shall, within sixty (60) days of the effective date of this Chapter, conform with all <br />provisions of this Chapter, including but not limited to the location restriction to <br />areas zoned industrial or commercial, and apply for and be issued a Business <br />License or cease operations. No citation issued, convictions under, failure to <br />comply with, or violations of this Code related to the operation of a Medical <br />Marijuana Collective, Dispensary, Cultivation Site, or other entity in compliance <br />20 <br />04202014- REVN30 <br />
