G. OUTSIDE OF SCOPE <br />Damage or malfunction to plant material or irrigation system equipment (from valve to <br />water meter), with the exception of irrigation heads and lateral lines, by any of the following <br />may be considered outside the scope of this Agreement: <br />(1) Acts of God <br />(2) Civil Disorder <br />(3) Vehicle Collision (excluding Contractor and its employees and subs) <br />(4) Excavation or re -surfacing of the street <br />(5) Power failures <br />(6) Underground wiring damage <br />Contractor will not be considered responsible for replacement. Contractor must prove to <br />the satisfaction of Director that one of the above occurred in order to be excused from <br />performing under the Agreement. <br />Scheduling of Work - Routine Maintenance <br />a) The Contractor shall provide park janitorial maintenance between in the <br />evening hours and be responsible for locking up the restrooms at the <br />designated park closing time Monday through Sunday. The schedule may be <br />modified at the City Representative's request. <br />b) The Contractor shall establish schedules of "routine work" to be followed in the <br />performance of this contract. Schedules listing the name and size of specific <br />crews performing daily, weekly, monthly, annual and periodic maintenance <br />shall be submitted to the City's Representative each month. A copy of these <br />schedules shall be provided to the City's Representative prior the performance, <br />and any changes in scheduling shall be reported in writing. The schedule shall <br />include days of the week and what person/crew will be performing specific work <br />in accordance with the specification. Each person/crew will be identified and <br />list the number of employees by job classification. Once the initial schedule of <br />..routine work" is completed the Contractor shall notify the City's Representative <br />in writing before any changes are made. <br />2. Work Force <br />a) Contractor's supervisory personnel (Supervisors) shall have a combination of <br />five years' experience or education in Building Engineering/Maintenance <br />Services, Mechanical Engineering, or related science. Supervisors shall also <br />possess janitorial management skills required to implement modern methods <br />and newly developed janitorial maintenance procedures and/or practices. <br />Supervisors shall accompany the City's Representative on weekly inspection <br />tours of the contract sites. During the tour the Supervisor shall indicate the <br />work completed the previous week, any changes that were made or are being <br />contemplated and the work scheduled for the upcoming week and month. <br />b) The City's Representative may evaluate each of the Contractor's staff and if <br />he/she finds that a Contract employee is not performing to the satisfaction of <br />Park Janitorial Maintenance Services RFP 14-002 <br />Page 16 <br />AW011 I111W-A <br />
