Harbor Boulevard Mixed Use Transit Corridor Plan <br />Findings and Facts in Support of Findings and Statement of Overriding Considerations <br />(OCSD) sizing requirements, particularly in 5th Street, Washington Avenue, Green <br />Drive, and McFadden Avenue. Several segments that serve the project area would <br />be further impacted by buildout of the Harbor Corridor Plan. These are each 10 or 12 <br />inches in diameter, and are all recommended for upgrade to 15 inches in diameter. <br />Implementation of Mitigation Measures 14 -1 and 14 -2 would ensure that a <br />development fee program is created to fund construction of necessary infrastructure <br />requirements. Furthermore, Mitigation Measure 14 -3 requires that project applicants <br />supply the City with necessary information regarding the sizing and location of <br />backbone facilities necessary to serve their proposed projects. Implementation of <br />these measures would reduce this impact to less than significant. <br />Mitigation Measures <br />MM 14 -1 Prior to the first building permit pursuant to the proposed project, <br />the City of Santa Ana shall prepare a "Nexus" Study that will serve <br />as the basis for requiring development impact fees under AB 1600 <br />legislation, as codified by California Code Government Section <br />66000 et seq. The established procedures under AB 1600 require <br />that a "reasonable relationship" or nexus exist between the water <br />and sewer infrastructure improvements and facilities required to <br />mitigate the sewer impacts of new development pursuant to the <br />proposed project. The sewer segment improvements shown on <br />Table 5.14 -11 of the DER are necessary to mitigate project <br />impacts and shall be included, among other improvements, in the <br />AB 1600 nexus study. <br />MM 14 -2 Prior to the issuance of the first building permit pursuant to the <br />proposed project, the City of Santa Ana shall prepare a <br />Development Fee program pursuant to the AB 1600 Nexus Study <br />identified in Mitigation Measure 14 -1, above. The Development <br />Fee program would fund the Harbor Corridor Plan area -wide water <br />and sewer infrastructure improvements. The fee program shall <br />stipulate that fees are assessed when there is new construction or <br />when there is an increase in square footage within an existing <br />building or the conversion of existing square footage to a more <br />intensive use. Fees are calculated by multiplying the proposed <br />square footage or dwelling unit by the rate identified. The fees are <br />included with any other applicable fees payable at the time the <br />building permit is issued. The City will use the development fees <br />to fund construction (or to recoup fees advanced to fund <br />construction) of the infrastructure improvements identified in <br />Mitigation Measure 14 -1. <br />MM 14 -3 Prior to the issuance of a grading permit, the project applicant <br />shall prepare water and sewer studies and identify the sizing and <br />location of backbone facilities necessary to serve the proposed <br />project, in accordance with City standards. The water and sewer <br />plans shall be submitted to the City's Public Works Agency for <br />40 July 2014 <br />
