CITY OF SANTA ANA <br />INSTRUCTIONS <br />LICENSE REQUIREMENTS <br />At the time the contract is awarded, the contractor shall be properly licensed in accordance <br />with the laws of the State of California, and must possess a contractor's license as identified in <br />the Notice Inviting Bids. <br />ASSIGNMENT OF CONTRACT <br />In accordance with Section 4552 of the Government Code, the BIDDER shall confirm that in <br />submitting a bid to a public purchasing body, the BIDDER offers and agrees that if the bid is <br />accepted, it will assign to the purchasing body all rights, title, and interest in and to all causes of <br />action it may have under Section 4 of the Clayton Act (15 USC Sec. 15) or under the Cartwright <br />Act [Chapter 2 (commencing with Section 16700) of Part 2 of Division 7 of the Business and <br />Professional Code], arising from purchases of goods, materials, or services by the BIDDER for <br />sale to the purchasing body pursuant to the bid. Such assignment shall be made and become <br />effective at the time the purchasing body tenders final payment to the BIDDER. <br />No assignment by the contractor of any contract to be entered into hereunder or of any part <br />thereof, or of funds to be received there under by the contractor, will be recognized by the <br />AGENCY unless such assignment has had the prior approval of the AGENCY and the surety has <br />been given due notice of such assignment in writing and has consented thereto in writing. <br />NON - COLLUSION AFFIDAVIT <br />The AGENCY shall require all bidders to execute and submit a non - collusion affidavit with the <br />Bid Proposal. The AGENCY reserves the right to accept the non - collusion affidavit before the <br />award of the contract. <br />Bidders are required to inform themselves fully of the conditions relating to construction and <br />labor under which the work will be performed. Any contract entered into pursuant to this <br />notice will incorporate the provisions of the State Labor Code. Pursuant to the provisions of <br />Section 1773.2 of the Labor Code of the State of California, the minimum prevailing rate of per <br />diem wages for each craft, classification or type of workman needed to execute the contract <br />shall be those determined by the Director of Industrial Relations of the State of California. <br />LABOR DISCRIMINATION <br />Attention is directed to Section 1735 of the Labor Code, as added by Chapter 643, Statutes of <br />1939, which reads as follows: <br />8 <br />SeRion 2 - b l rrformatlonSidders 09 -22 -2014 23A-1 9 <br />
